Elizabeth City Division This cause was heard be fore the undersigned upon motion of defendant for another year’s delay in completely desegregat ing the public schools of Edenton-Chowan and objec tions of plaintiffs thereto. History says he was a philosopher and a teacher. We know him as the man who gave us all the sayings that are quoted as: “Confucius Says.” There is one outstanding saying attributed to Confucius. It goes: “To study without thinking is waste of time; To think without studying is dangerous.” We all know that the two, studying and think ing. go together. It is difficult to indulge in one without the other. But, it seems it can be done. Very few of us have come through our lives without being guilty of hastiness. Hasty words spoken without thought. Spur of the moment decisions without thinking them through. And for these actions we have suffered or caused others to suffer. Small, widow, et als, Re spondents,” the under signed Commissioner will on Monday, the 17th day of March, 1969, at Twelve O’clock Noon, at the Court : House Door in Edenton, North Carolina, offer for sale to the highest bidder for cash, subject to the confirmation of the Court, those certain tracts of • land lying in First Town ship, Chowan County, North Carolina, and more particularly described as follows :• Tract No. 1: That certain tract or parcel of land, with all buildings and im provements located there on, bounded on the North by the lane leading from the old Edenton - Hertford Road to the land now or formerly owned by Jim Haughton; on the East by - the lands now or formerly .j owned by Jim Haughton and L. D. Bond - P. L. Rea land; on the South by the land now or formerly owned by the Powell Brothers - Boswell land; and on the West by the Old Edenton - Hertford Road, containing 75 acres, rpore or less, and being - ’known as the W. B. Small Farm, and being the iden tical real property convey : :«d to the said W. B. Small ’ by a certain warranty deed dated September 15, 1922, and now duly recorded in the office of the Register of Deeds of Chowan Coun ty, North Carolina, in Deed Rook O, page 558, an un divided one-half of which real property was convey -- ed by the said W. B. Small •'to Jennie A. Small by a certain warranty deed dat ed April 8, 1928, which deed is now duly recorded :*tn said’ office in Deed ; : : Book Q-2, page 918, and reference is expressly made to said deeds for further . description and chain of title. Tract 2: That certain tract or parcel of land. the evidence introduced by both parties, consisting of depositions, answers to in terrogatories and exhibits introduced during the hearing of this cause in July, 1968 and the oral testimony of defendant’s Superintendent. Upon the basis of this evidence, the Court makes the following Findings Os Fact 1. Pursuant to defend ant’s own admission in the hearing of this cause in July, 1968) and on the basis of the evidence then before the Court, the Court found that defendant could effect complete desegrega tion of its school system at the beginning of the 1969-70 school year and with all buildings and im provements located thereon and beginning at a sweet gum on the said Emperor Road (N. C. Secondary Road No. 1203); thence North 83 Vi deg. West 9 chains; thence South 26 deg. West 14 chains; thence South 35 deg. West 6.29 chains; thence North 50 deg. West 14.63 chains; thence North 42 deg. East 26.20 chains to run of swamp; thence the run of the swamp to a cypress standing near the run; thence South 13 Vk deg. West to the first station, containing 45 acres, more or less, and being the identical real property conveyed to the said W. B. Small by a certain war ranty deed, dated January 7, 1938, and now duly re corded in the office of the Register of Deeds, Chowan County, North Carolina, in Deed Book 2, page 127, and reference is expressly made to said deed for fur ther description and chain of title. There is excepted, however, from this con veyance that portion of said tract, described as follows: Beginning at an iron pipe on the West right' of way line of N. C. Secondary Road No. 1202, said point being further described as being 856 feet from the intersecting point of the West right of way line of said Road No. 1202 and the North right of way line of N. C. Sec ondary Road No. 1203 (Emperor Road); thence from said beginning point and running in a general Westwardly course 100 feet, more or less, to an iron pipe; thence running in a general Northwardly course 100 feet, more or less, to another iron pipe; thence running in a gen eral Eastwardly course 100 feet, more or less, to an iron pipe set in the West right of way line of said Road No. 1202; thence run ning in a general South wardly course along said right of way 100 feet, more or less, to Hie point and place of beginning, and ybeing the house and lot now occupied as the resi dence of Mrs. Thomas A. Small, and it is under stood that the title to said tract of land shall auto matically vest in the pur chaser of this said tract of land at Hie death of the said Mrs. Thomas A. Small, Federal Judge’s Order Concerning High Schools could take substantial steps toward a desegregated sys tem by the beginning of the 1968-69 school year. The Court, therefore, or dered defendant to desegre gate grades 1-6 effective with the beginning of the 1968- school year and to submit a plan for complete desegregation on or before January I, 1969, later ex tended, on motion of de fendant to and including March 1, 1969. 2. Defendant has moved the Court for another year’s delay contending that it cannot complete construction of some ad ditional classroom space until November, 1969, and possibly later. Defendant contends that the addition al classroom space is need ed to house the 700 stu dents in grades 10-12 at John A. Holmes High School which presently ac comodates 500 students. 3. Although defendant has been ordered to submit a plan for complete deseg regation on or before March 1, 1969, as of the date of this hearing it has advised the Court that it has not adopted a definite plan but is working toward utilization of the schools as proposed by a Survey Team of the North Caro lina State Board of Public Instruction. 4. No show'ng has been made or offered that de fendant cannot accomodate all students in the school system on a completely de segregated basis effective with the beginning of the 1969- school year. In deed, up until the filing of the instant motion, defend ant has assured the Court and counsel for plaintiffs that it could completely de segregate the school sys tem by the beginning of the 1969-70 school year. 5. While some additional facilities might be desir or at the termination of her 4 widowhood, which ever event shall first occur. The purchaser shall as sume all responsibility for the 1969 Chowan County I ad valorem taxes. What in convenience this might cause, if any, has resulted from the failure of the de fendant to take immediate and effective steps to im plement the Court’s order of July 30, 1968, requiring complete desegregation by the 1969-70 school year. Conclusion of Law 1.
