Bar AhmUUm) Intoxicated Persons May a person be convicted of a crime if he was invol untarily drunk at the time? No. If a person involun tarily, through strategem or fraud of another, or the neg ligence of his physician, be comes so drunk that he does not know what he is doing, he is not criminally liable for his acts. The drinking itself must be involuntary, for one cannot drink intoxicating liquors to excess or voluntarily take liquor in a social way, and, after committing a crime, say he did not intend to become drunk. May a person who has be come drunk be convicted of rape? Yes. Rape is not a crime requiring the proof of a spe cific intent. In North Caro lina the punishment for rape may be death. If it has this effect, the will is void. May a person obtain an absolute divorce if his or her spouse becomes a habitual drunkard or excessive user of alcohol or drugs? Not in North Carolina. It is, however, a ground for absolute divorce in all but eight states. Under a North Carolina sta tute the innocent spouce may obtain a divorce from bed and board or alimony if the defendant “becomes an ex cessive user of alcohol or drugs so as to render the condition of the other spouse intolerable and the life of that spouse burdensome.” The North Carolina statute does not require, as do the habitual-user statutes in a number of other states, that the defendant has been an I excessive user of alcohol or of drugs for a specified period of time. Furthermore, as the conse quence of a 1967 amendment, i the North Carolina statute dees not require that the plaintiff in an action for di vorce from bed and board (as distinguished from an action for absolute divorce) set forth in his or her complaint that the grounds set forth therein have existed for at least six months next pre ceding the filing of the com plaint.
