PAGE TWO-B Senator Sam J. Ervin Says WASHINGTON—The Senate has moved quickly in the new session to pass the om nibus drug abuse control act. Reviiion of federal drug law is long overdue, and for this I think many of the act’s provisions will be help* iul in dealing with a most serious national problem. At the same time, I am deeply concerned about the sudden impulsiveness of the Senate to vote for almost any provision which bears the “anti-crime" label. Last week, during a three-day debate, I strenuously opposed the in sertion of a “no-knock” pro vision in the drug control bill. It was distressing to me that in the Senate’s eagerness to do something about the drug problem many of its members emulated the ex ample set by Samson in his blindness when he destroyed the pillars upon which the temple of Justice rested. [ The “no-knock” provision of this bill is a horrendous blow at the heart of a free society. This drastic section, in an otherwise good bill, permits magistrates to allow federal officers in drug fel ony cases to break into a house without knocking if they can persuade the magis trate that an announcement of their presence would al low the evidence to be de stroyed. ■ At first blush, without examining what this does to a free society, many would say “so be it.” The trouble with this approach is that it ig nores one of the basic adages of our law that “every man’s home is his castle.” Under this 300-year-old English common law principle, an of tf alright!) >BUT ONLY j OFTTIMES only one medication is needed, if you treat illness at the first symptoms. The Senate action thus uproots a cherished precedent of individual rights. The bad thing about the “no-knock” solution is that it not only permits federal of ficers to break into people's houses like a burglar, but it tends to bring the law Into disrepute and endangers the lives of the officers. Under the law of every state in the Union, a man has a right to resist illegal entry into his home, and if he thinks an entry is illegal,' he has a right to resist it to the ut most. This raises a practical question: Who will condemn a man who picks up a gun to defend his home against an unknown intruder who smashes down his door and later turns out to be an of ficer of the law? True, this section of the bill is directed toward a grave problem—keeping drug pushers and addicts from de stroying evidence before it can be seized with a search warrant. Public feeling is running high on this issue, and it is said that the na tional urgency to do some thing to prevent drug abuse Justifies almost any remedy. On this point, I have repeat edly urged that we take sen sible steps to control crime and drug abuse without de lay. I hope that the House will review this problem thoroug ly and remedy the error which the Senate made in re spect to the “no-knock” sec tion of this bill. Hugh Rich, president of the SIOO-million system which has 30 branches in 19 cities across the state. Three new members of the 13-man central board of di rectors also were announced for the coming 12 months. They are: Euwell L. Motes, apple producer of Hendersonville; Albert P. Rachide, merchant of Jacksonville, and E. Davi son Potter, senior vice presi dent of First National. Rich, in pointing to growth figures included in a colorful 16-page annual report, noted the 178 per cent in earnings was from $369,009 to sl,- 027 936. On a per-share basis, this was equivalent to 120 per cent increase from 85c to $1.87 (compensating for a two-for-one stock split in ■December of 1968). Rich also noted that the ■ annual dividend reached the I highest point in First Na- j tional’s history —up 20 per j cent per share over last year | and amounting to a total of $459,806 this year compared to $271,875 last year.
