This recipe came to us
from the “what’s new” de
partment. Two exc.ting new
mixes Red Band Yellow
Cake Mix and Red Band
Chocolate Fudge Frosting
Mix—have joined Red Band’s
white and devils food and
the frostings now are choco
late fudge, creamy white and
fluffy white.
Banana Split Cake
1 pkg. Chocolate Fudge
Frosting Mix.
1% cups whipping cream.
1 pkg. yellow cake mix.
VS teaspoon soda.
1 cup mashed ripe banana i.
Vi cup finely chopped nuts.
1 pint brick strawberry ice
cream.
In small mixer bowl, com
bine frosting mix (dry) and
whipping cream. Cover , chill
one hour. "Prepare cake mix
as directed on package except
stir soda into mix, use one
fourth cup less water and
add bananas. Fold nuts into
batter. Pour into two greas
ed and floured square pans.
Bake 30 to 33 minutes. Cool
10 minutes; remove from
pans. Cool completely. Cut
ice .cream lengthwise into
four slices; place slices be
tween cake layers. If neces
sary, allow ice cream to sof
ten slightly; spread to within
one-half inch of edge of the
cake. Freeze. Blend chil’cd
frosting mix and cream: beat
until stiff. Frost sides and
top of cake. Freeze until
serving time.
One Thousand and One Goddesses of Mercy

Radiating in soft light, one thousand and one golden wooden images of Kannon,
the Goddess of Mercy, fascinate and amaze Japanese and foreign visitors alike who
make the trip to Sanjusangendo, in Kyoto. One huge image in the center and five
hundred smaller ones flanking it on either side were carved in 13-century Japan
in homage to Kannon.
Legend has it that when the Goddess of Mercy descended to the nether region in
quest of an unfortunate soul to save, the damned, on seeing her, forgot their tor
ments. The boundless blessings of that Goddess are shown in her numerous arms
and palms, in each of which is an eye.
Sanjusangendo, part of the Myohoin Temple of the Tendai Buddhist sect, is the
longest wooden building in the world. Situated in downtown Kyoto, it is less than
half an hour from Expo ‘7O

Leases By Co-owners
John Jones and Sam Smith

have been friends for man.
years. They and their fam
ilies have for several years
enjoyed the use of the cot
tage, at times jointly and at
other times separately. Re
cently John Jones leased the
cottage to Tom Turner for
the entire summer without
the consent of Sam Smith.
The customs and habits of the
Turner family are so objec
tionable to the Smith family
that there is no pleasure to
them in sharing the small
cottage with the Turner fam
ily. What are the legal
rights of Sam Smith and Tom
Turner?
The real property is owned
by John Jones and Sam
Smith as "tenants in com
mon.” Each owns an un
divided one-half interest in
the whole. The right to use
and occupy is vested in both.
In the absence of a contract
between the two co-owners,
neither is entitled to the sole
and exclusive possession of
the property.
Just as a tenant in com
mon may sell his undivided
interests to another without
the consent of his cotenant, so
may he lease his interest in
the property. Tom Turner
has acquired for the period
of his lease the same use and
enjoyment of the real prop
erty which John Jones had.
He is not entitled to the ex
clusive possession. Tom Tur
ner has acquired under his
lease the right to share the
whole of _ the property in
common with Sam Smith.
A tenant in common can
not give a lessee the exclu
sive possession of any part
of the land which will be
binding upon his cotenant,
unless he has been duly au
thorized to act as his co
tenant’s agent in making the
lease.
If a tenant in common pur
ports to give a lessee the ex
clusive possession of the
property, asserting that he
has authority to make the
lease as the agent of his co
tenant, when in fact he does
not, the other cotenant may,
if he wishes, ratify the lease,
expressly or impliedly as by
accepting his share of the
rent from the lessee.
Sam Smith does not have
a cause of action against
John Jones.
Either of the tenants in
common, John Jones and Sam
Smith, may petition the court
for a sale of the house and a
division of the proceeds.
A tenant enters into a valid
lease with all of the co
owners of real property.
May the lease be subsequent
ly modified or terminated
without the consent of all
the co-owners?
No. One of several ten
ants in common does not
have the power to modify
any existing valid lease with
out the authority or ratifica
tion of the other cotenants.
