Robert Gilbert Giborf Named Local Manager Robert Gilbert, 103 South Mosley Street, has been promoted to the position of manager of the Goodyear Service Store in Edenton, succeeding Joe Forehand. Gilbert, who has lived in Edenton for the past two •years, was previously employed by Goodyear in Wilmington. He is a native of Durham and graduate of Campbell College. H C Strangely enough, there were only eight votes against this proposal. In a much more controversial bill, the House by a vote of 223 to 206, refused to lift the embargo on trade with Turkey. Ibis was a bill in which President Ford and Secretary of State Kissinger, were most interested and exerted all pressure possible for its passage. This embargo was imposed on February 5 of this year as a result of legislation passed in December 1974. Those of us who voted for the lifting of the embargo did so because of the strategic military bases that this nation has in Turkey, and also with the hopes that the resumption of trade would help in the s negotiations to settle the dispute over Cyprus. The Senate had previously approved this action by a vote of 43 to 42. Unlike other foreign trade legislation, this bill contained no grant funds whatsoever. Also the House approved the Interior Department appropriations bill for fiscal year 1976. This office was fortunate to have included the sum of $338,000.00 for some much needed channeling and dredging at Lake Mattamuskeet. The greater part of the week was spent in a continuing debate on the energy legislation which came before the House the week before last, and at the time this column is being written has not been concluded, nor will it be until some time next week. The original bill has been amended so much that it is very difficult for most Members to keep abreast of all the changes. I have consistently voted against all amendnients which in my opinion would provide for a drastic increase in the price of gasoline. Also during the week, the President sent a Resolution to the Congress which he is required to do by law, asking permission to decontrol price regulations on gas and fuel oil, which we promptly rejected. So, for the time being, the controls remain in effect. Contract Legalities Clarified Contracts Between Husband and Wife May a wife enter into a valid contract with her husband? In North Carolina the answer depends upon the facts and circumstances of the particular case. Some contracts are valid only when certain statutory formalities are complied with, others are valid without complying with these statutory formalities, and there are still others that are contrary to public policy and are not valid under any conditions. No important contract should be entered into between a husband and a wife without prior consultation with an attorney. If such is not done, there may result bitterness and disappointment later. Such may not occur until after the death of one or both of the parties. *—O— May a wife convey the real property she owns to her husband? This may be done only when the requirements and formalities of Section 52-6 of the General Statutes are complied with. This statute requires a certifying officer of a court to privately examine the wife for the purpose of determining whether the conveyance is unreasonable or injurious to the wife. The certifying officer must be a justice of the Supreme Court; judge, clerk; assistant clerk; or deputy clerk of the superior court ; or magistrate justice of the peace. It was designed to give validity to transactions invalid at common law and to prevent fraud. —O— May a wife covey her real property to herself and her husband as “tenants by the entirety?” Only when the requirements of the above statute are satisfied. This is because the wife is in effect transferring to her husband an interest in her real property. The statute must be complied with even when the wife conveys her real property to some one other than her husband in trust for her husband. May a wife give or sell property other than real estate to her husband without complying with the requirements of this statute? Yes. The particular statute is limited in its application to real property so the wife and separation agreements. Military Records Subject To Change By Veterans The Veterans Administration reminded veterans of their right to request correction of what they feel are errors or injustices in their military records. VA Regional Office Director H. W. Johnson advised that application must be submitted to the branch in which the veteran served, but VA can provide the necessary Department of Defense form, DD-149, “Application for Correction of Military or Naval Record.” Johnson pointed out that while some errors may seem insignificant, correction could prove important, possibly resulting in eligibility for VA and other benefits. Generally, veterans are expected to file requests for correction within three years, but this deadline may be waived in interest of justice. Applications may be filed by the veteran, survivors, or legal representatives.
