The owner, operator, and all other producers on a farm that produce no set-aside crop qualify for loans and other program benefits, as for cotton or rice, even though the NCA is exceeded and even though they may be the owner or operator of another farm that exceeds the NCA and produces a set aside crop. L Will a farmer who has more crop acreage than certified be elligible for any benefits? The farmer will be eligible for full benefits when the certification is exceeded by no more than the smaller of 5 per cent or 20 acres. Ex ceeding the certification more than this will result in reduced benefits based on failure to fully comply procedure now being developed. M How shall the NCA adjustments authorized in Wire Notice PA-628 be coded on ASCS-652? Use Code “C” for ad justments authorized in subparagraphs 31-A-3 and A-5, 5-PA, in Wire Notice PA-628, and for corrections by appeal to include crops overlooked in 1977 because acreage reports were first obtained only for program crops. N How does the program apply to NCA crops double-cropped? Double-cropped acreage was credited only once in establishing the NCA and will be charged only once to the NCA in the current year. If the crops in 1978 are wheat and-or feed grains, separate acreage must be set-aside for each crop. Example: Afarm with an NCA of 100 acres and 100 acres of wheat in 1978 could designate 15.4 acres of the wheat as set-aside for w'heat and 7.7 acres as set-aside for corn, harvest 76.9 acres of wheat for grain and follow it with corn. If this farm set aside 16.7 acres for wheat and harvested 83.3 acres of wheat for grain, no corn could be grown because no NCA remains for corn set aside. Soybeans or other crops with no set-aside could follow the wheat. O Should a State or National Wildlife Refuge or any land acquired by eminent domain have an NCA? Yes, if it had NCA crops in 1977. Exclude the acreage produced for the refuge for wildlife. Such acreage excluded in 1978 will not be charged to the NCA and will not have program coverage. P - Can land summer fallowed be set-aside? Yes, provided it is protected from erosion by a ’ practice approved for the State. Stubble mulch, for example, may be an ap proved practice used on summer fallow. Q Can land be be designated as set-aside in 1978 on a farm cleared of timber in 1977 for 1978 NCA crops, thus qualifying for an NCA? No. The land will not meet eligible set-aside requirements until it is tilled in one of the previous three years in the producation of a crop for other than hay or pasture. R Would the average for 1974-1976 be used under procedure in subparagraph 68-A-l, 5-PA for a low yield in 1975? No. The average for 1972- 1974 would be used. S What is the intent of paragraph 84, 5-PA? The intent is to adjust the actual yield for any year of the base period that exceeds 120 per cent of the yield established for that year, unles the production was from enough acreage to be representative. T ls a set-aside required for a feed grain or wheat approved for prevented planting payment? No. However, any acreage credited for low yield payment must have a set aside.
