James B. Garrison. D-Stanley, was convicted of careless and reckless driving after drinking. He had been charged with driving under the influence of alcohol, but the charge was reduced. | Judge Phillip O. Redwirife ruled that the state had not proved beyond a reasonable THE CHOWAN HERALD doubt that Garrison’s mental or physical condition was appreciably impaired by the alcohol. Garrison failed two standard “field tests” (touching the tip of the nose and walking bed to toe on a straight line) and was taken to Wake County Courthouse where he registed .16 on the breathalyzer test. A reading* of .10 is considered “legally” intoxicated. The arresting officer probably deserves a medal of valor or something of the sort since Garrison, at the arrest site, proffered a business card telling who and what he was instead of the car registration requested. Garrison testified in court how the two items were similar. The senator’s credit, he' has had only one other driving violation (a speeding ticket) in 40 years of driving. Garrison was arrested May 28 at 1:30 A. M. while driving home from a legislative party. Such party’s are almost a nightly occurrence during regular sessions of the North Carolina General Assembly.
