Tax Evaders
Are Prosecuted
If you do your best to pay
your Federal income taxes
on time, the Internal
Revenue Service wants you
to know they are at work
protecting your rights, says
Glenn Jones, IRS public
affairs officer in Greens
boro.
“Those persons who use il
legal tactics to avoid paying
their taxes are ‘illegal tax
protestors,”’ Jones said.
“We are very aware of the
movement in North
Carolina and have recently
prosecuted two people
charged with violating tax
laws. One claimed
protection of the Fifth
Amendment of the Con
stitution against self - in
crimination and the other
filed a false W-4 withholding
statement. The Fifth
Amendment protestor is
now serving a one - year jail
term and the false W-4 filer
was fined.”
While illegal tax protest
activities in North Carolina
have been minimal so far,
such is not the case
nationwide. On the national
level, 69 illegal tax
protestors were prosecuted
from October, 1981, through
May, 1982, resulting in 61
convictions. This success
rate represents an upward
swing in the percentage of
illegal tax protestor con
victions from 62 per cent in
Fiscal Year 1981 to 88 per
cent in the current Fiscal
Year.
“It is apparent that courts
are becoming disgusted
with the frivolous and
docket - clogging claims the
protestors are making.
Judges have served notice
that harsh sentences are to
be expected,” Jones said.
A case in point is the
recent attempt by a group of
Michigan people who were
encouraged by protest
leaders to file false W-4’s.
The resulting trials ended in
jail terms and substantial
fines for nine violators.
Jones said, “We are
seeing some of these same
schemes popping up in
North Carolina. It’s possible
that some members of
Condo’s group are in our
state recruiting new blood.
They are masters at giving
misleading information,
usually in return for a fat
fee. In addition to the W-4
and legal tender dodges,
other schemes people should
be watchful for include the
Fifth Amendment of the
Constitution against self -
incrimination. In this
scheme the person often
sends in a tax form, omit
ting dollar data with which
the IRS can compute the
tax. The protestor adds the
statement that no data is
provided due to the Fifth
