Little Hope m Redistricting Order REDISTRK2TING—The North Carolina General Assembly’s 1982 redistricting I took another step backward last week. U.S. Chief Justice Warren Burger refused to grant a stay of a previous court to redraw several legislative districts that, ac cording to a federal three judge panel, violates the voting rights of blacks, The decision by Burger was not altogether unexpected I and legislative leaders said late Friday that the motion for a stay would now be taken before the full U.S. Supreme —Court.-;-^ Privately, however, the legislative leaders aren’t holding out a great deal of hope in fighting the redistric ting order. Conversations ap parently have been con tinuous, since the original order, about initiating still another one-day special ses sion to resolve the issue. If the full court turns the stay down, then legislative leaders will move immediate ly to petition Governor Hunt to call the legislature back to Raleigh. The governor has already agreed to that action , if he is asked. But as has been the case all along with this redistricting deal, time is short. The origianl order said the new formula for the districts must be in by March 16,1984. If not, then the judges will redraw the problem districts themselves. That is something the lawmakers don’t want. Current plans are to have the special session on March 6th, whether the full court has heard the legislative appeal or not. That supposedly would allow a second “tune-up” job if the March 6th effort gets an immediate rebute. More likely, the court will play around with the March 6th plan long enough to throw the May 8th primary date in to dissaray-at least in the case of the legislative seats. It’s that possibility that gives some observers hope that the lawmakers will be certain that the March 6th (dan is ab solutely acceptable-to avoid delaying the May 8th primary. “They know what the courts want. They just have to make up their minds to do it,” said one well-placed member of the 1982 conference com mittee on redistricting.
