On« Flea Market Law Passes • ✓ Si The North Carolina General Assembly has ratified legislation that will require those who sell at flea markets, or who sell from a truck parked alorife the side of a < road to obtain and display a $25 state privilege license and a sales tax number. Failure to do so is punishable as a misdemeanor of up to 30 days, and/or a $200 fine. Further, the operator of a flea market is required (under the same penalty) to maintain a dai ly list of flea market vendors and their appropriate privilege license and sales tax number. Under this statute, a person selling from a truck must obtain written permis sion from the property owner. “The North Carolina Retail Merchants Association believes that this legislation is an equitable solution that will create a level playing field for all sellers in North Carolina, and thereby pro tect the consumers,’’ said Fran Preston, NCRMA lobbyist. There are exceptions (tracking the state’s sales tax laws): household personal property, farm and craft products produc ed by the seller and charitable non-profit organizations are ex empt. But if the vendor buys for resale, he will need to purchase the $25 annual state privilege license (good anywhere in the state) and obtain a state sales tax number. This law will go into effect July 1, 1988.
