Wilson Defends His Cigarette Customers (From Atlanta Journal The long-smoldering controver sy involving shipment of tax-free out-of-state cigarettes into Geor gia flared anew Wednesday An official of one North Carolina firm threatened legal action" asainst what he termed "recent illegal seizures" in Atlanta. He also promised the employ ment of competent counsel to de fend any of his firms customers charged with receiving cigarettes by mail and to pay their fines if ? upheld by higher courts." Harvey Wilson, manager ot the Cigarette Sales Co., Murphy N". C . which has been mailing cigarettes into Georgia for the past 10 >ears. accused state revenue officials of resorting to propaganda bas ed on misrepresentation and false hood" to halt the mail-order cig arette business He said that they have been telling prospective purchasers that out-of-state sellers can be re quired to furnish the names of purchasers from another state and that information about shipments can be obtained from the various post offices This Mr. Wilson denies em phatically. He calls the claims I '"bare-faced falsehoods ' and says they are "submitted as propaganda to frighten people." Mr. Wilson added "It is not unlawful for anyone to purchase I cigarettes from without the state or from any other source. The Georgia law attempts to make it unlawful to consume the cigarettes without first affixing tax stamps to the individual packages. How ever. the law does provide a time element for the procurement of such stamps, but to date the tax officials have made no provisions whereby a consumer can purchase these stamps " In a circular letter to its cus- j tomers the firm says that the state tax tobacco law is primarily a "li- j cense tax on dealers." and that I any provision which attempts to impose a tax on consuming is "il logical" and inequitable." The new controversy resulted from the seizure last Thursday of 103 cartons of cigarettes which had been shipped to a group at the Southern Railway office, here The seizure was ma j by agents of the State Revenue de j partmenf. Glenn Phii'lps, state revenue J agents, aid Wednesday that the State Law department had ^een i asked to investigate the possibili ty of legal action against the in i dividuals to whom the cigarettes ' were addressed. I He also pointed out that under a decision of the State Supreme court revenue agents had authori ty to seize the cigarettes. How ? ver. he sjid. they had to give the purchaser one hour to procure state tax stamps for them. Mr. Wilson, in his letter to cus 1 tomers. invited them to wire him ' collect or call at his expense to I report any seizures. Domestic production of each of the tobacco products in 1948 probably will be as large or larg er than in 1947 but tobacco ex ports are ikely to tall below last year when they were a fourth less than in 1946 and 35 per cent less than the record year of 1919 Citfar consumption in 1947 total ed 5.631 million compared with 5.914 million in 1946 The drop occurred despite the high level of personal income.
