AN ORDINANCE PROVIDING FOR THE 30-DAY QUARAN TINE OF ALL DOGS WHEREAS, a number of dogs have contracted rabies within the I vicinity of Murphy within the past few days, and it is probable that a number of dogs have been bit ten by the dogs already mad and an epidemic of rabies is feared; and whereas, the city authorities are informed by the rabies inspec tor that a very large proportion of the dogs in the City of Murphy and surrounding vicinity have not been vaccinated, as is by law pro vided; and whereas, there are a targe number of dogs roaming the 1 streets of Murphy who apparently have no owners and. not being vaccinated, are a potential men ace. as well as a nuisance to the ; public at large: And whereas, the North Caro lina State law, General Statutes i 106-364 to 106-387. provide that : :?!1 dogs shall be vaccinated for i rabies annually; Now therefore, be it ordained j by the Mayor and the Board of > Aldermen of the Town of Murphy; | SECTION I. That all dogs of any sex or strain within the city ' limits of the Town of Murphy shall be confined by their owners upon i their own premises for a period of 30 days, provided that during said 30 days a dog may be permitted to leave the premises of the owner if on a leash and under the con trol of its owner or other respon sible person, or if the dog be ade quately and securely muzzled. SECTION II. During said per iod of 30 days, which shall expire midnight July 14. 1949. it shall be the duty of every dog owner within the Town of Murphy who has not had his dog vaccinated within the past 12 months, and who does not own a certificate to that effect, issued by the rabies inspector, to have said dog vaccinated by the rabies inspector; any dog which does not have around its neck a numbered tag issued by the rabies inspector shall be deemed to be an un vaccinated dog, unless other- 1 wise shown by the owner. SECTION III. On and after July 13, 1949 unless due to condi tions prevailing, this period of con finement is extended by the Board of Alderman, all vaccinated dogs may be released from confine ment; any dog not vaccinated within a period of 12 months pre ceding shall continue to be con fined by its owner upon his own premises, subject to the provision of Section I hereof, until such time as the dog may have been vaccinated, and for a period of 21 days thereafter, at v^hich time the dog may be released SECTION IV. Any dog found j roaming at large within the city l'mits of the Town of Murphy, ' within the aforesaid period of con- j l'inement, shall be impounded by I the police force; at any time within a period of seven days from its impoundment, the owner of the dog may claim the same by paying the fees hereinafter set out and proving to the satisfaction of the police force that the dog has been vaccinated within a period of 12 months previous to such date; any cog not claimed by its owner with in a period of seven days shall be killed by the police department ^nd its body disposed of. The fees to be paid by the owner before he may procure release of his dog shall be fifty cents (50c) for its seizure and impoundment and fifty cents <50c> per day or frac tion thereof during which the dog shall have been impounded. SECTION V. During the per >d of confinement, as aforesaid, or during any extension of the period declared by the Board of Aldermen, it shall be unlawful for i the owner thereof to allow any dog at large within the city limits of the Town of Murphy; after the period of confinement, or any ex- 1 tension thereof, shall have expir- j |ed, H shall be unlawful for the ? owner of any dog to allow the same at large within the city limits of the Town of Murphy without having complied with the provi sions of this ordinance. SECTION VI. Any person vio lating the provisions of this ordi nance shall be guilty of a misde meanor and may be fined not exceeding $50 00 or imprisoned for a period not exceeding 30 days.
