PURPOSE OF NOTICE
This notice is intended to
meet two separate require
ments of 24 CFR Part 58: (1)
To provide notice to the public
that the Town of Pembroke
has determined that the re
quest for release of
funds for the above named
project will not have a signifi
cant impact on the environ
ment. (2) To provide notice to
the public that the Town of
Pembroke is requesting the
release of funds for the
above-named project.
FINDING OF NO
SIGNIFICANT IMPACT
It has been determined
that such request for release
of funds will not constitute an
action significantly affecting
the quality of the human
environment and accordingly
the above-named Town has
decided not to prepare an
Evironmental Impact State
ment under the National
Environmental Policy Act of
1979 (PL91-190). ,
The reasons for such deci
sion not to prepare such
Statement are as follows:
It has been determined that
the proposed project, which
will include the rehabilitation
of 16 Substandard dwelling
units; cleaning and piping
1200 L.F. of drainage ditches;
paving 1200 L.F. of dirt
streets, and extension of
sewer service to seven (7)
families, is not an action
which will significantly affect
the quality of the human
environment.
An Environmental Review
Record respecting the within
project has been prepared by
the Town of Pembroke which
documents the environmental
review of the project and more
Fully sets forth the reasons
why such Statement is not
required. This Environmental
Review is on file at the Town
of Pembroke Town Hall and is
available for public examina
tion and copying upon request
at the Town Manager's Office
during normal business
hours.
No further environment re
view of such project is
proposed to be conducted
prior to the request for release
of Federal funds.
PUBLIC COMMENTS ON
FINDING
All interested agencies,
groups and persons disagree
ing with this decision are
invited to submit written
comments for consideration
by the Pembroke Town Coun
cil to the Mayor's office at the
above address. Such written
comments received on or
before January 10, 1983. All
such comments so received
will be considered and the
Town will not request the
release of Federal funds or
take any administrative action
on the within project prior to
the date specified in the
preceding sentence.
RELEASE OF FUNDS
The Town of Pembroke
will undertake the project
described above with Block
jjrant funds from the .North.
Carolina Department of Natu
ral Resources and Community
Development under Title 1 of
the Housing and Community
Development Act of 1974. The
Town of Pembroke is certify
ing to NRCD that Pembroke
and James A. Jacobs, in his
official capacity as Mayor,
consent to accept the jurisdic
tion of the Federal courts if an
action is brought to enforce
responsibility in relation to
environmental reviews, deci
sion making and action; and
that these responsibilities
have been satisfied. The legal
effect of the certification is
that the Town of Pembroke,
may use the Block Grant
funds and NRCD will have
satisfied its responsibilities
under the National Environ
mental Policy Act of 1969.
OBJECTIONS TO STATE
RELEASE OF FUNDS
- NRCD will accept an
objection to its approval only
if it is on one of the following
bases: (a)that the certification
was not in fact executed by
the certifying officer or other
officer of applicant approved
by NRCD; or (b)that appli
cant's environmental review
record for the project indf
cates omission of a required
decision, finding or step ap
plicable to she project in the
environme?*al review process
Objections must be prepared
and submitted in accordance
with the required procedure
(24CFR Part 58) and may be
addressed to NRCD at P.O.
Box 27687, Raleigh, N.C.
27611.
Objection to the release of
funds on bases other than
those stated above will not be
considered by NRCD. No
objection received after Jan
uary 10, 1983 will be consider
ed by NRCD. Comments must
specify whether they concern
the finding of no significant
impact or the intent to request
release of funds.
