DAY CAM FACILITIES " PARS Several yean ago. North Carolina enacted legislation to regulate day-care facffltiea. One of If a intention* in regu lating day-care facilities was to assure that children in day-care facilities were being cared for by persons of good moral character, and that their physical safety and moral environment were pro tected. In order to cany out such an intention, the General Assembly obviously had to control the type of person who coukl own a day care facility for children and who could be employed to work with chil dren in a day care facility. Thus, the North Carolina legisilation carefully sets -out qualifications for those who own day care facilities as well as for those who work in day care facilities. Nortn Larouna s legislation requires that each day care facility required to be licensed must be under the direction or supervision of a literate per son at least 21 years of age. All staff members must be at least 18 years of age or a high school graduate. However, the law does provide that a person less than 18 years of age, but at least 16 years of age, mpy work in a day care facility as long as that person is under the direct supervision of a regular staff member who is at least the age of 18. In addition to the age requirements, the General Assembly also provides in its legislation that no person can operate a day care facility or be employed in a day care facility if they have been convicted of a crime involving child neglect, child abuse, or moral turpitude. This provi sion means that an unsub stantiated charge or rumor about a person being involved in child abuse, child neglect or moral turpitude is not sufficient to keep a person from owning or working in a day care facility; a person must actually be convicted of a crime involving one of these three elements in order to be barred from a day care facility.
