Bank, Administrator of Blackwell Carrington, deceased Oct. 21, 28; Nov. 4, 11 five Civil Rights Workers Freed; Charges Lifted LEXINGTON, Ky.—Kentucky officials have failed to appeal a U.S. court ruling that the state sedition law violates the' First Amendment to the U. S. Constitution. This means that the Sept 14 decision of a three-Judge federal court stands. Five civil rights and poverty workers ar rested under it are freed of charges against them. The five are Alan and Mar garet McSurely, Pikeville, Ky.; Joseph Mulloy, Virgie, Ky., and Carl and Anne Braden, Louis ville. The Bradens are execu tive directors of the Southern Conference Educational Fund (SCEF), an interracial group working all over the South. The McSurelys are mountain j oranizers for SCEF and Mulloy ] is field director in Pike Coun- | ty for the Appalachian Volun- 1 teers (AVs). The AVs do com- \ munity work among the poor in , the mountains and have helped I in the fight to stop strip-min- ! ers from ruining the moun tains. The McSurelys and Mulloy were arrested at their homes I on Aug. 11 and 12 by raiding parties led by State's Attorney Thomas Ratliff. Ratliff, who i." also the Republican candidate for lieutenant governor, seized books, papers, and other per son belongings of the accused. On Sept. 11 the Pike County grand jury indicted the Mc- Surelys, Mulloy, and the Bra dens on sedition charges. The law had been voided in 1936 in another case involving the Bradens, but Ratliff said the 1936 decision did not cover 'edition against Pike County. The federal judges, by a vote of 2 to 1, said they could not see how a person could com mit sedition against a state or county "without in part over throwing the government of | the United States." NAACP Legal Defense and Educational Fund, (LDF) at torneys told the high court in their brief against the Board of Commissioners of Jackson, Tenn., that school segregation Is still rampant across the south. The LDF utilized services of a panel of national educational experts in evaluating school segregation in Jackson, a medi um-sized city in mid-western Tennessee. Jackson's policies follow "a course which perpetuates seg regation for the overwhelming majority of Negro students while paying lip service to the obligation to desegregate," the LDF maintained. The case provides "an espe cially appropriate vehicle to consider the general problem of evasion of the obligation to desegregate," the Supreme Court was told.
