Marion Frank Crawford Gets A New Trial Marion Frank Crawford, on death row at Raleigh's Central Prison since 1964, will get a new trial. The Winston Salem man had been indicted for rape and murder of an eight year old girl late in 1963. He was tried ■and' convicted of murder early in 1964 in the Forsyth County Superior Court. The new trial was ordered earlier this month by the U. S. 4th Circuit Court of Appeals. The appeal was handled by Durham attorney Moses Burt. In reversing Crawford's con viction the court said exami ning judges would have to ask prospective jurors before a trial whether their views on capital punishment would have any effect on deciding guilt or in nocence in the case. At Craw ford's trial in 1964 every pros pective juror who expressed conscientious scruples against the death penalty was excused by the prosecution as is re quired by North Carolina law. Judge Harrison L. Winter wrote in the opinion that 34 of T5 prospective jurors had been disqualified because they said they opposed capital pu nishment. All of the jurors chosen to try the case, Burt argued and the appeals court said, were in favor of capital punishment. The opinion read: "We cannot escape the con clusion that, as a result of in- (Paid Political Advertisement) Vote for FRANK JARMAN For County Commissioner Democratic Primary Vote May 4th Welfare League to Convene in New Orleans at the June Hotel NEW ORLEANS—The South ern Regional Conference of the Child Welfare League of America will take place in New Orleans on May 20, 21, and 22nd at the June Hotel. "Such disqualifications pre vents the jury in its function of determining the issue of guilt from being fairly repre sentative of the community and thus violates equal pro tection of the laws." The opinion has mandatory effect in the 4th circuit, which includes West Virginia, Mary land, Virginia, North and South Carolina. The court's decision also .nay be used as a guideline for similar cases in all other federal dDpellate court circuits. Romp MINDS are \U* CON". CR.KTK: AIJ. MIXKTI up nnr\ permanfhlly SET.
