If the offender resists and takes life he is held guilty of murder. His Honor riext spoke of the men who stir up jaw suits, and'toid the jury it was their duty to consider. these things ; The cases of J men wuo swore lies : men wiio bribe c tne' I peace of the county ; are there any riots? any rows? any unlawful assemblages? have any persons by force taken the property of others? These are things to be considered, ferretted out and reported upon . Assault is the least offence known to the law. It is not only an' actual striking but a threat to hinder a person from going his way. The presenting of a gun is held in law td bo an assault, eveu if the gun be not load edr provided the person at whom it is pre sented does not know that it is not. loaded. You see how careful the law is to protect person. - You can have no difficulty in de termining what the law is ou this matter. There are higher crimes of this class, such as rape, wnicu is carnal knowledge or a le- male against her will. Whether by her con sent or not, the law holds connection with a child under ten years 01 age to be rape. There are also murder, manslaughter, excu sable or justifiable homicide. What grades these crimes may belong to, is not for vou lo decide? : ' Another thing : Larceny is the faking and carrying away of property not your own. If a person receives property, knowing it to be stolen, he is equally guilty with the person who stole it. If a person secnre3 property by means of false representations he is lia ble to indictment. His Honor then went on to expound the law in regard to burglary, arson, public roads, fences, marking of stock, retailing of spirituous liquors, selling or giving away pf liqjLor on days of election, or twelve hours before or after such -days ; seUuag liquor within one mile where diyirie wor ship is in progress, gaming and gambling houses, diseased stock, creating nuisances, bauly hoase3, patting obstructions in pub lic highways, weights and measures, public health, &c. His Hfohor touched next upon the late act of the'. Assembly, in reference to the jurisdic tion of Justices of the Peace, Different Judges have given different decisions on this sub ject? As forus.we.will for the present "have to grope along" until the question is ' decided by the Supreme Court. Your jury is composed of 18 men. It will be necessary for 12 of you to agree before vou can decide"to find "-'a true bill" or "not a true bilT'; in any case?" .When you do so decide your foreman will endorse on the back of the writing a true bur or "not a true bill" as yoa decide. The above is an accurate synopsis of Judge Logan's charge. We have made it from full notes, but have not attempted to follow the words. There is nothing new in it. It is the same charge he has delivered in every county of his district each time he has held court. Perhaps the only variation was in his remarks upon the act of assembly in re gard to Justices of the Peace, and in these His Honor showed that he is still himself, in being willing to just "grope along."
