Be it ordaiqed by the Mayor and Board of Aldermen, of the city of Char lotte, in council assembled, that the Board may appoint a City Engineer, whose doty it shall be to locate and find the boundaries of lota and streets, and grade the sidewalks and drains thereon, when called upon for that purpose. Section 2. tse it farther ordained that hereafter any person bailding or about ta baud any boose or fence on any site, or con struct any sidewalk or pavement fronting or bounding on any ot. tne streets or ine city or Charlotte, snail be required to nave - tbe same located or graded, and the boundaries thereof adjoining sucn street pr;streets, nxed and certified to by, the city engineer, and in case any person shall .construct any bouse. fence, sidewalk or pavement, as foresaid witbont liaving tbe' same located or graded by the city engineer as aforesaid, such per. son shall be subject : to a f fine of not more than fatty dollars lor each and every offence, at the discretion or the Mayor, provided that in such case, as aforesaid tbe city en gineer, shall be said . for his services : by the party so building, constructing', &c, a fee to be fixed by. the Street Committee.
