While the Court of Ap peals, in the Btate of New York, in "Lamb vs. The First National Bank," pf Whitehall, held that they do, apply to : the National Banks, ....-.. The ground on which the Supme , Courts of Ohio and Massachusetts" base their opin? ions iaj'r'that a National Bantis a conve nient, useful and 1 essential .Instrument in the prosecution of the fiscal operation, of the Federal Government; that they,, were created for national purposes and Endowed with such faculties as were necessary to en able them to efteefc this object: That being so created, for this object, the5 State has no power to defeat it by the enactment of .usu ry laws,- or in. their.own ! words :' That the power of creating'such hanks," being vested in Congresst is inconsistent with a power in any, State or Territory tq.-afSx penalties, on the bank for taking unlawful interest," Mc Cullogh ys Maryland, 4 Wheaton, p. 316, is" relied on to sustain this position, a ; ; i . . The Court of Appeals iu New Y'ork,- as sumes Ihe opposite ground: ' That f the Federal Government has no concern ' with the htisffiess operations of the' Bank, ' . That they may ,ba selected. as"!depbsitories of the public money or financial agents of . the government, but in so far as? their-private business and contracts are concerned, the act does not assume to place "them on any different footing from natural -persons se lected by the Government for the perform ance of some special function." That National Banks do not bear the same relation to the FeJeral Government, that th United States Bank did, and therefore, that the principles decided iu "McCullogh vs. Maryland," supra, and "Osborne vs. United States Bank," 9 Wheaton, p. 738, do not ap ply to them. ... So that, so far as this question can be set tled by the Supreme Court of North Caro lina, it will, most probably, depend on the View it takes of the objects and purposes for which Natrona! Banks were created ; whe ther they were created to effect uational pur poses, or whether like other bank corpora' tions, they were established directly for pri vate profit and gain and indirectly "as ve hicles for the issue and circulation of a cur rency based on the credit of the Federal Government." ' . - This Court being subordinate in its char acter, it is its duty, if possible, to ascertain the view of the Supreme Court of North Carolina, on this question, and to follow it This question was directly involved in the opinion of the Court in "RufiSn. vs. -'The Commissioners of Orange," 69 N O Reports- p. olv, aeciaea in iod. xt arose in tne ais cussion of the right of the State--to- tax Na tional Bank bills, Justice Reade in the opin ion says:-' nfiiifftni "The power of the State to tax the circula tion of National Banks, depends upon whe ther they are for 1 the use of the United States Government or for private profit. It is there tbey were authorized by Congress as a currency convenient and useful for; circu lation, just as State bank bills are authoriz ed by the State. Bat in neither case have they necessarily : any connection with ithe govern ment. The Act of Congress author ising .National . Jianks, : imposed t. a tax on theii circulation of two percent, and surely that would not have been done if they had been regarded as a part of the government. The truth is, the United States Government has no interest In National Banks. It au thorizes them, in order to provide a curren cy; not for the government but for the peo ple." .1 The discussion is, clear and unequivocal, and its conclusion (that the State may tax National Bank bills) is, in my opinion, cor rect and fully sustained by authority' and reason. , . . .... , Bnt it seems that, eyen,' if' the National Banks were created 'for-?therxise of the Unit ed States - .Government," , that our statute does not defeat this object or obstruct the legitimate operations of theNational Banks.
