Wilmington Star : A case of small- nnx nas been reported on a vessel undergoing repairs at Messrs. Cassidy fc Koss' ship-yard. As soon as the disease was pronounced spall-pox by Dr. A- E. Wright. Superintendent of Health, the Mayor had a guard .placed over the vessel, with instructions to permit no person to come on shore or go on board, except the physician in attendance. Orders have also been given to haye the .vessel removed be o the "Dram Tree," arid efforts were being made yesterday afternoon to get her off the ways for that purpose. The Raleigh flews says: Adolphus Moony of Rutherford was senteuced to twelve months imprisonment in the c unty jail and judgment was given against him for the coits of the prose cution. Before his imprisonment ex pired Gov. Brogden pardoned him and he was discharged without having paid the costs. The Solicitor., then tailed on Moony to show cause why execution shouldn't issue for the cost, and in answer thereto he pleaded the Governor's pardon. Judge Schenck held that such was not the effect of the pardon and ordered the execution to issue, and Moony appealed to the Supreme Courts There '-w as no error in the judgment below. Judge By num in rendering the decision, said that an absolute pardon discharged a fine imposed, because that goes to the public, and the Governor, represents the public, but the costs belong to pri vate persons, aud the pardon can no more discharge the costs than it can discharge a debt due by the defendant to a third persoo.
