The full Judiciary Committee has decided not to surrender Kilbourne. The resolution giving the Real Es tate Pool Committee power to investi gate the crooked actions of all govern ment officers and members of the present House, covers Blames case. Director, Harrison, of the Union Paci fic, will tell that Committee about it. Detectives Atwood andSam'l Felker are working against Whitley in the safe burglary. J Russell Jones' ac counts are in question. Sergeant-at-Arms Thompson appear ed before Chief Justice Carlton this morning and stated tbat the House of that the would be very easy it would be for the Sergeant-at-Arms to apply to the Supreme Court of the United States, which had an appellate and revisory jurisdiction, and thus the question would be settled peacefully and con clusively. Garfield Can the Supreme Court of the United States revise a matter of contempt in the court below ? Hurd It can; and that is the prop osition which I have baon maintain ing all the time that where a court possesses appellate and revisory juris diction, and the facts can be brought before it by a writ of cei iorari, it can judge of the contempt. Frye, of Maine, asked Hurd whether he claimed that the House had power to punish for contempt regardless of the fact whether the question which Kilbourne refused to answer was law ful or unlawful ? Hurd replied that the subject was entirely witbin the discretion of the House, and that the adjudication of the House was final and conclusive on every other authority. The Judge, in consideration of this and other circum stances, adjourned further proceedings in the case until Tuesday morning at 10 o'clock. There seems to be no doubt that Babcock, Harrington and others will be indicted to-day for alleg ed participation in the safe burglary conspiracy. It is understood that Harrington has left the country. The case of Journal Clerk Smith, charged with issuing circulars for busi ness in bounty claims, has been refer red to the Committee on Rules. In tJie Purman case, it appears that the condition upon which Dr Simp kina' son should be appointed, was that Simpkin3 should contribute $300 to a fund to elect Witherspoon to the Legislature. The House is considering the report of the Judiciary Committee in favor of a refusal to obey the writ of habeas corpus in the Kilbourne case. THE CITY. CLUB. A FULL LINE FLASHES. Frye In your opinion is there any limit to the time of punishment expect the life of the House? Hurd In my judgment the power to punish expires with the House. Frye If that power inheres in the House of Representatives, does it not also inhere in the Senate? (Garfield Which never dies. Hurd Unquestionably it does? Frye Then this result would follow: that the Senate may punish a recusant witness for contempt regardless entire ly of whether the questions which the witness refused to answer werelawfuljor unlawful, and might hold that citizen in jail during his life. Hamilton, of New Jersey Cannot any Court do the same? Frye No ; no Court in Christendom can do it or any other power. Lynde, of Wisconsin, a member of the Judiciary Committee, offered, on behalf of the minority, a substitute for the resolution directing the Sergeant-at-Arms to make a careful return to the writ of f&sl&as erpt, thafthe pris oner is duly held by authority of the House of Representatives in the pro ceedings against him for contempt and to take with him the-substitute, Kilbourne, before the Court, when making such return. He proceeded to argue in support of the substitute. The discussion continued until 5 o'clock, when Hurd gave notice that he would call the previous question at 3 o'clock Monday. Adjourned. It is understood that all those indict ed except Babcock and Harrington, will be used as witnesses in the safe burglary trial. Harrington's where abouts is still unknown. In the matter of the dismissal of Williamson from office and the dis continuance of proceedings against Judge Wright, for forgery, George Dyer, Assistant District Attorney for New York, testified that a criminal case was pending in New York against Wright, which he considered strong, and which should be pr3ecuted. In the House, the bill authorizing the Presi$ent of the Senate to admin ister oaths passed. A resolution reported by the Ju diciary Committee directs the Ser geant at Arms to make a. careful Teh- turn to the writs setting out the causes of the detention of Kilbourne, and to return custody of his body, and not to produce it, before the Judge or Court, without further order of the House. In support of the resolutions. Mr Hurd intimated that the testimony of Kilbourne might implicate high offi cials pf the Government require their impeachment but all efforts in the direction of the investigation would be thwarted if he was allowed to be on the evidence to be furnished by Wil liamson, his dismissal had prevented trial. Judge Fisher has been sum moned. Lawrence, of Ohio, and Hoar, of Massachusetts, Republicans, made strong speeches to-day in favor of the majority resolution in the habeas corpus case.
