Gossip: A resolution will be introduced in the House in a few days to investigate Col. Ordway, Sergeat-at-Arms under Blaine. It is alleged that great dis crepancies exist in his accounts, ag gregating thousands of dollars. Clapp refuses to appear before the Committee on Printing. House. The Sergeant-at-Arms pre sented the facts in the Kilbourne case to the House; referred to the Judiciary Committee. The bill removing the disabilities of Gen. Slaughter, of Ala bama, passed. It had already passed the Senate. The Legislative and Ex ecutive Appropriation Bill was taken up. The amendment giving $14,000 for the assay office in New Orleans, upon which a separate vote was de" m anded while the bill was in comm lttee, was adopted, and is part of the bill. The appropriation for the assay office at Charlotte, N C, was reduced from $4,000 to $2,700, and is part of the bill. The committee investigating Gen. Boughton, reports that he had been indicted but the indictment had been dismissed. They report that affairs in Texas were in an unsettled condition, and without recommending action, asked that he be discharged. Gen. Boughton, who had been waiting this result to embark in other business, re signed his place as clerk. The military investigation of the vessel Mary Merrett, is progressing favorably to Bristow. The Senate suspended legislative business at 1230, and the impeach ment trial was resumed. Chief Justice Carlton to-day render ed his decision in the Kilbourne habeas corpus case. After reviewing the causes tending to the issuance of the writ, the return thereof and the claims of the respective counsel, he decided that sec tions 104 of the revised statues, rela ting to recusant witnesses, and approv ed January 22d, 1874, is explanatory of section 102 of previous acts in relation to such witnesses. Tho last legislation on the subject and the present law, the 2 sections, are as follows : Sec. 102. Every person who, haying been summoned as a witness by the authority of either House of Congress, to give testimony or proauce papers upon any matter under inquiry before either House of Congress, wilfully makes default, or who, having appear ed, refuses to answer any question pertinent to the question under in quiry, shall be deemed guilty of mis demeanor, punishable by a fine of not more than one hundred dollars, and imprisonment in the common jail for not less than one month nor more than 12 months. Sec. 104. Whenever a witness sum moned as mentioned in section 102, fails to testify, and the facts are re ported to either House, the President ot the Senate or the .speaker ot tne House, as the case may be, shall certi fy the facts under the seal of the Sen ate or the House to the District Attor ney for the District of Columbia, whose duty it shall be to bring the matter be fore the grand jury for their action." ( Consideration of the Conflicts Be tween the Church and State. Rome, April 28. The representa tives of some of the great powers were recently in conference with several in fluential cardinals with the yiew of ascertaining the best means of bringing to an end the conflicts between the various States and the Church. The cardinals unanimously declare that peace was impossible unless the spirit ual indifference of the Church was acknowledged. The alliance and agreement between the Church and Stale was regulated by concord, and without either party being made sub ordinate. Madrid, April 28. Washington, D. C, April 28. Wal ter H. French, of Boston, has been appointed Journal Clerk of the House. A quarter of a million of legal ten ders have been retired. The outstand ing legal tenders are now three hun dred and seventy and a half million. Prof Purottin Toulouse has discov ered another planet of the 12th mag nitude. Six and a half millions will be dis bursed Monday on Alabama claims. The briefs in Senator Spencer's case have been submitted. They will be argued at the next meeting. Ames before the Mississippi Com mittee testified to the existence of a general sys tern of intimidation, fraud and violence, by which voters in Re publican counties were prevented from voting. He found it impossible, with out bloody collisions between the races, as he was not supported by Uoops, to secure the negroes their rights. In the recent election there were riota, shooting and threats. The peace officers in some instances were overawed; in others exiled. He claim ed that the pretext of robbing the State by excessive taxation, wa whol ly ungrounded, that taxation in Miss issippi is only seventy cents per head against sixteen dollars in New York. It is proposed to have him continue bis testimony several days. Bristow lost his temper in the com mittee room to-day, and intimated that Bright, of Tennesse, had gone even outside the committee room to get at evidence in the case prejudicial to him, and refused to shake hands with Bright. The two finally explain ed themselves in good nature. I Kilbourne gave $5,000 bail and was discharged. Senate. The Judicial Appropria tion Bill then passed, 20S to 17, and goes to the Senate. The bill appro priating $50,000 for the Apache In dians, passed. The House went into Committee of the Whole on the pri vate calendar. Adjourned. In the Cabinet, Mexican affairs were discussed. The Secretary had no late reports of outrages on the American citizens on the Rio Grande. The latest advices to the War Department repre sent matters in better condition. Re presentatives of cigar manufactures are here in opposition to Morrison's tariff, which increases the duty on Ha vana and other imported leaf. They say it will make a difference of five dollars per thousand on cigars manu factured in this country from Havana tobacco. The resolution in the impeachment question was upon the motion of the managers to hear evidence before ar guing the question of jurisdiction. Carpenter argued that the managers were attempting to manage the case on both sides. It was not the inten tion of counsel for the accused to cause anjr unnecessary delay in the case, but I they had prior professional engage ments, and had not yet had time to prepare themselves for argument on the question of jurisdiction. He ask ed that the matter be delayed for two weeks from to-day. They would then ask no further postponement. Their only object was to present the ques tion of jurisdiction as its importance demanded. Lord, on the part of the managers, opposed the request of counsel for accused for postponement, and asked the Senate to hear the evi dence in regard to jurisdiction. He had the witnesses ready this morning, and asked that they be heard. Conk- ling: submitted an order that the Sen ate proceed first to hear and deter mine the question of whether Bel knap is amenable to trial by impeach ment for acts done as Secretary of War notwithstanding his resignation. Further discussion by counsel fol lowed. Carpenter said they would contend that an officer of the govern ment had a right to resign, and the motives which govern the resignation cannot affect the matter. Manager Lord said the evidence as to jurisdic tion was mostly of a docum entary char acter, and it would not take over an hour to hear it. Edmunds submitted an addition to Conkling'a order that the managers and counsel in their ar gument of whether the issues of facts are material.: The Senate then retired, and after the conference of Senators, the' follow ing ,)rder was ' announced as having been agreed upon.-i . .-.' Second, .Or dered that the hearing proceed on the 4th day of May, 1876, at 12:30 o'clock ; that the opening and close of the ar gument be given to the respondent ; that three counsel and three managers may be heard in such order as may be agreed on between themselves, and that such time be allowed for argu ment as the managers and counsel may desire. The managers on the part of the House opposed that portion of the or der in regard to respondent being al lowed to open and close the argument. A lengthy discussion followed, and finally it was moved that the order be set aside. Pending discussion the Senate setting as a court adjourned till Monday. GOODS !
