Boston Traveler. O'Bara vs. Kitchir. Raleigh Observer, 15th. Much interest ia felt in the pending controversy between O'Hara and Mr. Kitchin for a certificate of election to the Forty-sixth Congress. O'Hara's complaint alleges error in the action of the county canvassing boards of Hali fax, Edgecombe and Craven in reject ing the returns from various precincts in those counties because of irregulari ties pretended or real. The matter has been heard by Judge Seymour, who on yesterday rendered his judgment, de ciding that the county canyassing boards of Halifax and Edgecomb6 erred in re jecting the returns made to them in their respective counties ; that the ir regularities complained of did not viti ate the vote, and that their powers were ministerial only, and is sued a mandamus to the members of their boards commanding them per emptorily to meet at the county seats of their counties on Monday at 2 o'clock, p. m and to canvass all the returns made of the November election, and to make due return of their action imme diately to the State canvassing board. The board of canvassers of Craven demurred to O'Hara's complaint, be cause it failed to allege that the can vassing and counting of the rejected re turns by that board would, have given him a majority of the votes past His Honor sustained the demurer, but gave leave to the plaintiff to amend his com plaint It is understood that the canvassing board will take the question.Ao the Su preme Court for review by appeal. They have already given notice to that effect in the event of an adverse decision by His Honor. The State board of canvassers meets on Wednesday next the day to which they have adjourned, to act in the pre mises. Negroes Shot in Florida. Jacksonville, Dec. 14. About a month since, a mill at Mt. Caric, Co lumbia county, was set on fire by four negroes, 5 The superintendent of the mill extinguished the flames before much damage was done. While the superintendent was absent from his home, the negroes entered, beat his wife severely, and stole $200 in money. They were arrested next day, confessed their crime, and were committed to jail in Lake City The jail was burned about a week since, and the men were re moved to the court house. This morn ing at 3 o'clock thirty or forty disguised men overpowered the guard, took the prisoners out, shot two dead and mor tally injured the third; ; and the fourth escaped and has since given himself up to the authorities. tarrynif tohcealed' Weapons. ' STATE AGRICULTURAL SOCIETY. Meeting of ihe Executive Committee Report of the Fence Law Committee. Raleigh Observer. The executive committee of the North Carolina Agricultural Society held an impoitant meeting at the 'Yarborough House, on Thursday evening, 12th inst Present: Col. Thos. M. Holt, President ; Messrs. A. Creech, Dr. Eugene Grissom, N. S. Harp, Julius Lewis, John C. Blake. Dr. P. E. Hines, John Nichols, W. G. Upchurch. Maj. W. H. Bagley, P. A. Wiley, Treasurer, and C. B. Denson, Secretary. The treasurer rendered a f ull and satis isfactory statement, which was referred to a committee consisting of Messrs. Blake, Lewisy and Upchurch. The secretary presented the report of the committee appointed at the late an nual meeting of the North Carolina Ag ricultural Society to investigate ihe workings of the fence law in the county of Mecklenburg. He also reported that the committee appointed to leam the views of the farmers of the State upon the desirability of the law laying a tax upon the sale of fertilizers had been prepared, and was undergoing examina tion by one member of said committee, resident at a distance. On motion of Mr. P. A. Wiley, it was resolved that the thanks of the execu tive committee be tendered to the gen tlemen who have made these investiga tions in behalf of the farmers of the State, and that their reports be publish ed, and a copy forwarded to the com missioner of agriculture. General discussion then ensued, and many excellent suggestions were made for the benefit of the society and the improvement of the annual State fair. WHAT THE COMMITTEE SAY OF THE FENCE LAW. The report of the committee on the workings of the fence law will be fouud below : ,,; Tarboro, N. c Nov. 20, '7a To the Executive Committee of the North Carolina State Agricultural Society : Gentlemen: The undersigned com mittee, appointed by the North Caro lina State Agricultural Society to visit Mecklenburg county, in this State, and gather information in regard to the working of the fence law, m that coun ty, giving attention to the opinions of all classes oteople in regard to it, after a trial of several years, etcn respectful ly report: That they took adyantage of the op portunity to meet the farmers of Meck lenburg during the fair of the Caroli nas, at Charlotte, on the 14th and the 15th inst. There they talked with farmers from nearly all parts of the county, and found a most decided endorsement of the advantages, conveniences and economy of the law, and were informed that many, who were at first opposed to the law, nave become reconciled to it and admit not only its economy but its convenience and its advantages. Of course there are some who do not like it but so far as we comki learn from in quiries made , of many .farmers from various part of the. county, the above seems to be the decided sentiment of ade cided majority of thepeople of the coun ty. Mr. Thompson s nends take this oeeasion to say that he has been a consistent supporter of the Democratic-Conservative party from the first and all the time, as well in the dark days of party defeat as in the brighter days of victory, and that he contributed greatly to the final redemp tion or Davidson county trom misrule. He was a Confederate soldier during the whole of the war. These, with his good address and pleasant manners, we think, especially fit him for this posi tion. Coroner Taylor being appealed to, saw no reason to doubt that Mr. B. was indeed dead. The body was put mthe coffin, and the condensed air gathering again on the surface Of the glass over the face of the deceased, raised similar false hopes, and the coroner was again appealed to. He said that Mr. Boschen was undoubt edly dead, but to satisfy all parties that there snouia not ne a premature inter ment, he directed that the funeral should be postponed until this arter noon. How ! Radical . .Ballot-Box Bluffers are Rewarded. The; (Washington correspondent of Saturday's New York Herald tells an instance . in which one of the Republican judges of election in Florida in ,.1876, has been rewarded by Sherman with an appointment in the United State treas ury , department, and, this man open ly boasts that it .was owing to seventy four ballots which he, . stuffed into the ballot-box over which t he had charge, that the State- went for 1, Haves.
