The farmers have been getting in some solid work on wood hauling for the past several weeks, at prices reason able to seller and buyer. t3T A party of about 75, from along the line of the Carolina Central Rail way, passed through the city last night en route to Atlanta. EST Wade Ilarris, of the Concord Sun, came over yesterday to make ar rangements for some of his constitu ents to visit Atlanta with the party that is to leave here to-night. BJpThe meeting of the Galaxy cl nb appointed to be held at the residence of Col. H. C. Jones next Thursday night has been postponed until the Thursday night succeeding by order of the presi dent, in order to give the members an opportunity of attending "Olivette." Sunday morning the dwelling of Policeman Irwin, corner of Church and Third streets, caught fire from the chimney. The fire was soon discovered and extinguished, with no other dam age than the burning of a small hole in the roof. IWIt is a matter of importance to witnesses summoned to attend the federal court that they should report to the district attorney immediately upon arrival in the city, as they will only be allowed pay from the time of such re port. GEfTSeats for the Comley-Bartoh op era Thursday night are selling rapidly. Those wishing to secure reserved seats should do so at once, as the choice ones will soon be taken. This will be de cidedly the greatest event of the amuse ment seasou, and one which theatre-go ers cannot afford to pass by. tW It is understood that Capt. Tom Murphy has resigned his position as conductor on the Western North Caro lina Railroad, with a view of leaving the service entirely. He has held the position of conductor on that road for some six years, and during that time has made himself very popular with the public. Capt. Woods has been ap pointed to the vacancy. ( Sentence Commuted. Governor Jarvis has commuted the death sentence of Jim Greenlee, con victed of rape at the last term of Bun combe court, to imprisonment in the penitentiary for life. a Cam Wrecked. An accident occurred on the .Rich mond and Danville road last Sunday, near Harrisburg, by which it is said three freight cars were thrown from the track and wrecked. No one was injured, and the track was cleared of all obstructions in time not to inter fere with the running of the mail trains No Basinet Transacted. The United States Court was duly opened yesterday, but owing to the lateness of the hour of the arrival of the judge, no business outside of an or ganization was transacted. The court will meet this morning at ten o'clock when the grand jury will be drawn and the dispatch of business entered in to. Through the leart. It is learned from a gentleman who arrived in the ctj yesterday, from the west, that Eekiel, Austin was instant ly killed in Bakersville last Thursday by the accidental discharge of his pis- tl, the ball passing through his heart Austin was tried for his life at the last term of Mitchell court for the murder of Tilman Vance, but was acquitted. He was about 25 years old. Sunday School Organized. Rev. J. B. Cheshire, rector of St. Peter's Episcopal church, Sunday or ganized a Sabbath school at the brick school house in the First ward. By s,uch organizations as this many nuie children can be brought into the Sunday school, and perhaps h$ church, who would possibly otherwise never enter either, if they were left to attend the Sabbath schools at the churches. Woods, of Galveston, Texas, who sometime azo received a call to the pastorate of the Seeond Pres byterian church, of this city, has ac cepted, and will enter upon the dis charge of his duties some time in Janu ary. Rev. Mr. Woods has for some time been filling the pulpit of this church with acceptability to the con' gregation. "OllYette." Next Thursday evening we are to have "Olivette" at the opera house by the Comley-Barton company, from the Fifth Avenue Theatre, New York. It is claimed that this is the only London version of this sprightly opera bouffe ever given in this country, and the com pany is the largest and best-appointed organization now traveling. It has a cast of fifty-six persons, and among them some of the most noted light opera artists, such, for example, as John Howson, Frederick Leslie, Minnie Walsh (the Mabel of the "Pirates,") Ar mand the tenor, Frear the basso, Cripps the baritone, and a full chorus. They come to us from the South, where they have been well received. Personal mention. Among the legal gentlemen who have wrived in the city, we note Gen. John stone Jones, of Asheville; Col. P. J. Sinclair, of Marion ; Hon. D. Schenck, of LiD coin ton; Hon. J. L. Henry and Theo. F. Davidson, Esq., of Asheville ; Hon. Cha3. Price, of Salisbury, and R. McBrayer, Esq., of Shelby. Hon R P Dick, judge of the district court, arrived in the city on the noon tram yesterday. W. C. Kerr, State Geologist, passed through the city last night on his return from the Atlanta exposition. Mr. Whiting Allen, agent of the Claire Scott dramatic company, is in the city, and will to-day make arrangements for the appearance of his company at the opera house on the night of the 19th. Captured Two Geeae. Sunday morning about half-past 3 o'clock, while Policemen Carter and Blackwelder were tramping around the city, they came upon a negro men near the corner of 5th and B streets, and re garding him as suspicious, hailed, when he commenced moving off at a rather lively pace. The two policemen also quickened their movements, and one of them made a break for the negro, when he took to his heels and a lively chase ensued. After pursuing the fugitive for three or four squares he was lost in the darkness. During the race one of the officers thought he saw the negro throw something away, and on return ing over the route a bag containing two geese wa3 found at the spot where it was thrown by the negro. Thegeese are in possession of the officers, and if any one has lost such property they can call on the gentlemen named and secure them. Bishop Lyman's Visit. Sunday, at St. Peter's Episcopal church, this city, Rt. Rev. T. B. Lyman, bishop of this diocese, filled the last ap pointment of his visitations, and preach ed to a large congregation, both morn ing and evening. The bishop's sermons were exceedingly impressive, and are highly spoken of by those present. At the close of the sermon in the evening a number of candidates presented them selves at the altar for confirmation, and the rite was administered with much solemnity, after which the bishop ad dressed at some length the newly-con firmed members upon the duties and responsibilities of their new relations. Sunday was the anniversary of Bishop Lyman's Consecration as bishop, which event took place eight years ago from that date. The large congregations which go to hear him when he visits Charlotte i3 a fair index to the esteem in which the reverend gentleman is held by the public generally. He left the city yesterday evening for his home in Raleigh. SKiutrial tn a Rape Case, We are informed by a correspondent at Salisbury, that the case of Morris Locke, colored, indicted for committing an outrage on the person of a little white girl aged 8 years, was tried at Rowan Superior court last week, Solici tor Dobson being assisted in the prose cution by Mr. Theo. F. Kluttz, and the defense conducted by Hon. Chas. Price. The case was given to the jury on Mon day evening, and after remaining out all week they came into court at 10 o'clock on Saturday night, the close of the term, and being polled by His Hon or, Judge Eure, declared that they could never agree upon a verdiet, whereupon the judge ordered the withdrawal of a juror, and a mistrial to be had, and re manded the prisoner to jail until the next term of the court. From this rul ing the prisoner's counsel prayed an ap peal. The jury was composed ot n wnices and one colored man, and it is said that from the beginning the ballot was eleven for conviction to one for acquit tal. The Railroad Tax Case A motion will be heard today, before Judge Dick, of the United States Co urt for an injunction to restrain the tax collectors of the counties of Burke, Mc Dowell and Buncombe from collect ing the taxes claimed to be due from the Western North Carolina Railroad to the counties named. The amount ft volved is said to be about $9,400, and embraces the taxes for theyears 1880- 81. An order was granted a short time ago by Judge Dick restraining the officers from proceeding to collect the tax until the motion for an injunction could be - heard. On the 5th of December a bill in equi ty was filed in the Circuit Court with the view of testing the constitutionali ty of the liability of the Western North Railroad to county and State taxation in the hands of the present owners- This is returnable on the 1st Monday in January, and the motion to-day will be for a temporary injunction pending the hearing of the bill in equity. The plaintiffs to the proceedings are Messrs. A. S. Buford, T. M.Logan and W. P. Clyde, suing as non-residents, in dividuals and assigneesunder the Best contract. The suit is brought against the county commissioners of Burke, McDowell and Buncombe counties, the Western North Carolina Railroad Com pany, Gov. T. J. Jarvis, Hon. J. M. Worth, State Auditor W. P. Roberts and D. A. Jenkins, trustee. Ex-Judges Schenck and Bynum are counsel for the plaintiffs. Gen. John stone Jones and T. F. Davidson, Es q., are counsel for the commisioners of Burke and McDowell counties, and Col. P. J. Sinclair represents the com. missioners of Buncombe. Associated with the counsel for the commission ers are Messrs. Jones & Johnston of this city. The question at issue is one of im portance to every county through which the Western North Carolina Railroad passes, as well as to the pres ent owners of the road, as it will settle the question as to the right to tax the road, which has for some time been in dispute.
