Where an unjustified undertaking on appeal was filed with and approved by the clerk, as shown by this mem orandum, but.no note made on the record that the same was accepted by the appellee without objection ; Held, that the subsequent bigning by the counsel of the appellee of the "case" settled for this court, does not constitute a waiver in writing of the legal requirements m perfecting appeals, and hence the motion to dismiss the appeal for want of justi fication of bond, was allowed. Hamphill vs. Black welder. Appeal dismissed upon motion, for want of justification of bond. The court say that it is a matter of as tonishment that intelligent gentle men of the bar persist in sending ap peals to this court without perfecting them as required by the plain and peremptory provisions of the statute, and if the court were disposed to grant relief against such negligence, it has no authority to do so. Elerring vs. Burgin. Appeal dismissed, upon motion, for want of justification of appeal bond. McGlennery vs. Miller. 1. A dred mide in 1852 by hus band and wife, conveying the wife's land, was required to be first ac knowledged by the husband and wife, aud then her privy examination taken ; and unlers this order of ac knowledgment and probate was ob served, the deed is ineffectual to pass title either to the interest of the wife or that of the husband as tenant by the c mrtesy initiate. 2. A husband tenant by tho cour i tet-y initiate has an interest in the land and is a necessary party to a suit respecting it ; and if he refuse to become a co-plaintiff in ah action by the wife to assert her right to the i property, he should be made a party defendant. 3. But where the action concerns her separate property or is between hereelfand her hucband, she may sue alone. Cod, section 178. Bridgers vs. Morris. It is not necessary to insert, in a mortgage deed, a provision for giving notice to the mortgager of an intend ed sale uiider a power contained in the deed, in advance of the advertise ment. Capehart vs. Biggs, 77 N. C, 261, overruled as to this point. (The word "not' was inadvertently omit ted in copying this head-note at the editor's office, and published in yes terday's itsue.) Price vs. Deal 1. In m action for damages for breach of covenants in a deed, the court, under "the prayer for general relief," will give suc' relief a3 the justice of tf.e case demands. 2. If the action be for breach of covenant fov" quiet enjey. ent, an eviction mast be alleged and proved; but if for th;:t of seizin, it Is sufficient to negative the -words of the coveoaci and to allege and prove the grantor had no ttle. In cithe case the meas ure of damages is the price paid for the land, with interest. 3. Where the tit'e of the grantor fails as to a part of the l.nd con veyed. as here, and the grrntee pays a hundred dollars to exf " "uish the outstanding: title, the measure of damages L? the 6um so mid, provided it does not exceed the value of that part ; but"if it exceed such value, the rule for the guidance of the jury is not the quantity but the value that such part proportionately bears to tho value of the whole tirct, esti mated by the consideration in the deed. Wiseman vs. Witherow, 1. The Superior Court has no juris diction of an action to recover upon a running account of $312 where it is shown that from time to time the defendant had reduced the amount by sundry payments, to a sum under $200 at the time the action wes brought. 2. While the sum demanded ordi narily determines the juiisdictio. i, yet the plaintiff must make his de mand in good faith and not for the purpose of giv?'ng the court jurisdic tion. Yancey vs. Greenlee. 1. The defendant's defence, resting upon an alleged possession of the land under one of several tenants in commoj, has no application to the fact3 o this case. 2. A motion to dismiss an appeal for want of an appeal bond will not be entertained alter argument. Rule 2, section 5, page 597 North Carolina reports. 3. Nature, at this Juncture, need? something to assist In throwing off the im purities vhlch have collected by the sluggish clrou kition or blcod during the cold winter months, bwii't'a Specific is nature's great helper, as it Is a purely vegetable alterative and tonic. Rsv. L. B. Pnine. Macon, Ga. writes: "We have been using Swll t's Specific at tiie orphan's home as a remedy for blood complaints, and as a general health tonic, and have had remarkable results lrom it-, uce on the children and employees of tne institution.
