' Ashevflle, March 15.-The taking of teetlmony Tor the plaintiff in the case of th North Carolina Mining Com nanv vs. the Westfeldts was resumed at Bryson City to-day by Special Mas ttV Garland Thomson. This is an other branch of the litigation that has been la-the State courts for several years .and known as the Westfeldt Adams great copper mine case. The property In 'dispute lies in Swain county. JBoth, the Westfeldts and Mr. Adams claim title to the land on which" are copper deposits valued at more than $1,000,000. The case 4ias been tried several times and at each and every trial sensational developmnts have been the order of the day. Some time last year the North Carolina Mining Cnmnanv. a New York corporation. claiming title to the land by virtue of purchase from Mr. Adams, Instituted a suit in equity in United States Cir cuit Court for the purpose of clearing the clouded title. This new suit in no wUe Interfered with the suit still pending In the State' courts and the result is the unique situation of a suit In the State court and a suit in the United States Court over the same piece of. land. in the equity end of the litigation heard before Judge Pritchard, the court held that it had Jurisdiction and Instructed that testimony be taken. This is now being done. At the rate of progress made the taking of testi mony bv both sides will require probab ly the remainder of this year. Thus far six witnesses have been examined for the plaintiff and it is said that there are something like 90 more. The de fendant will also have a great volume of testimony. When complete, the evi dence will be submitted to Judge Pritchard and he will render his de cision in the matter. Whether this de cision Is favorable to the plaintiff or tho defendant art appeal will undoubt edly be taken to the United States Circuit Court of Appeals and from this court probably to the Supreme Court of the United States. The fight for possession of the copper mine lands Is one of the most Important and Interesting suits that has ever been had In western North Caro lina. Able lawyers are employed on both sides and every trial Is featured by a wonderful display of legal ability. The end of the suit is apparently far off and the entire cost of the litigation will total a huge sum. One lawyer conversant with the case aald to-day that the cost of the law-suit Including attorneys' fees would not fall far short of $150,000. A 40-FOOT PMTNGE. March 15.--One of the hlg engines of the Southern, pulling a freight train, was derailed a short distance below the station last night. The freight had pulled on to the sid ing for passenger train No. 35 to pass. After this, the freight puncu oui ami instead of running onto the m.ln llnH run Into the coal chute at the Alpine Cotton Mill and plunged down about 30 or 40 feet. The flagman rushed back to the station and gave the alarm and a rescuing parly went down. Fortu nately the engineer and fireman es caped with slight bruises. Up to this hour the huge engine lies there help less, waiting for the wrecking train to pick her up. Court has been In session this week. Judge Justice on the bench. There were no cases of special interest on either criminal or civil docket. The largest crowd In attendance for some time was on hand and a great deal of horse-trading was Indulged In. Mr. V. C. Newland, of Lenoir, Is among the visiting lawyers. Mr. McWaughton. of Marlon, Is here to look after the new furniture factory which will be i-omniMiced right away. Mr. Mc Wnughton will move his family to Morranton. Mr. William Penn Davis Is here this week getting the farmers Interested In the proper seeds for the best yield for the canning factory. The. The motion was based on the grounds that the defend ant Is interested in a bankrupt case which requires his personal presence in order 10 be properly adjusted. Victor Rube, Seaman on Revenue Cutter Seminole, Bound to Federal Court for Refusal to Obey Officer's Commands. Correspondence of The Observer. Wilmington, March 15. Victor Rube, a Swrde, engaged as a seaman on the revenue cutter Seminole,-waa given a trial before United States Commission er S. P. Colder to-day on a charge of insubordination and mutinous con duct on board his ship this week, while the cutter was at the stranded schoon er Myrtle Turner on Frying Pan shoals. Rube's offense is alleged to have been refusal to obey the com mand of Capt. Qulnan to go on board the schooner and assist in throwing off, a part of the deck load of cross ties in an effort to get the distressed vessel afloat. Several of the crew re fused, with Rube, to go aboard and do the work but, upon being called on deck and hearing the law read, all obeyed the command except Rube. The cot ton trade at certain times in the past has been considerably stirred up by famous luncheons at the Waldorf-Astoria, but to-day it was thrown into no little ex citement by the haDoenines at a dinner In Little Rock last night at which Theo dore a. .fries and prominent New Or leans operators were entertained. What happened was that Price announced that he was a bull of the most pronounced type. - This news did not leak out until well Into the middle of the morning. Certain large operators In New York re ceived first and surprised both, rings by purchasing large lots of cotton and later when the news that the bear leader had abdicated was ken rally known, there was scattered buying from professionals wntcn put tne maraet up ana gave it a firm undertone. The outside public re fused to come in and at noon, the mar ket had but little snap to it and values were only , ten points , hlghee than, yester day's closing, which was hardly consis tent with the reputation that the ex-bear leader has of influencing the market by bis own attitude toward it. Perhaps the secret of "the calm of the market over ,the news concerning Price was to be found in telegrams put out by a very few firms In New York which stated that Price probably did not have a very large long line and was only try ing to put prices up so that he might secure a better selling basis. Again, the trade might have shown more Interest in Price's views if the final census bureau report on ginning had been - farther away. As it was, Mr. Price stated that he did not expect a report of much over 10,600,000. Few people expect such low figures and -many argue -that such figures might come from one whO, was secretly bearish and who wished to discount the effect of even lower "figures, which the trade, uninfluenced might be bullish. In this connection, it Is well to state that the census bureau reported 9,998,111 bales ginned to January 16 and afterward esti mated that there was ginned on January 16 250,884 bales, a total of 10,249,000. Price's last report on ginning counted about 10,350.000 bales which seemed to hit the popular fancy and It seems to be more conservative to take this amount than to take the census figures to get a basis for making an .estimate of the SPECIAL REDUCED RATES VIA TUB SEABOARD.
