Counsel then gave notice of ap peal' to .the Supreme Court. In passing the sentence Judge Fer guson took occasion to address the prisoner on the enormity of his crime and of the view taken by the law. He said that he did not know wheth er a new trial could be secured and warned ' the prisoner not, to T rely-too strongly on that but to prepare him self for the future. While he spoke, tear gathered In the eyes of the Judgn and he said that it was one of the hardest duties imposed upon man. While the verdict of the Jury wa being taken and when sentence waa being passed, Hodgea never changed In the least and there was not a tremor of a nerve In his body. When leaving the court, room after the pronounce ment of sentence he walked with a steady step, talked with the officer and gated around at the. crowd In an Interested sort of way. He defended the witnesses who had been attacked by counsel for the defense and said that the reason no toher witnesses were called (there were many who talked with Hodges) waa that the Statehad Vrought forward men who could be believed and trusted and that was all that was necessary.
