Discrimina tion and unjust rates are the charges filed with the Intcr-Htate commerce commission to-day against many of th Important lines of railroads of the country by shippers. Two com plaints, each involving important points for the consideration of the commission, wero placed on file, and It is likely that both will result later In hearings. On complaint Involves the freight rates charged by Bouthern roads for the shipment of fruit to the. Northern markets. The complaint Is brought by J. U Waxelbaum Company, fruit commission merchants, of Ma con, Oa., and all of the. railroads In the South which have Northern con nections are made defendants. The complainants allege that the rates on peaches, for Instance, from Macon and Atlanta are 7S cents per tiundred pounds to Washington and Baltimore, ad Hi cents per hundred to Philadelphia and New YrV They aver that these rates ere unjust end unreasonablo and that a fair rate would would bo 68 cents to Washing ton and Baltimore and 81 cents to Philadelphia and New York. Before adjourn ing th term, of Durham Buperlor Court thla afternoon Jndga Fred Moore, who. heard the matter of th Blackwell Durham Tobacco Company, of thta State, against lh Blackwell Durham Tobacco Company, and th American Tobacco Company, of New Jersey, and other of this State, ren dered a decision In which h refused to remove from th courts of xh Stat to the Federal Court th mat ters now pending. The Judge signed two orders, one refusing to remove the case from the State courts and another thst the clerk of the court shall Issue a rule to be nerved upon Oeorge W. Watts, director of the American Tobacco Companja making him a party to the matters In litiga tion. The same orders allow th de fendants ten days as of thla term In which to file an answer. The gen eral supposition Is that there will be an appeal and that a second effort will be made to get the entire matter Into the Federal Courts by an order from that court. When recent ap plication was mad to Judge Jeter C. Prltc.hard to order the removal of trial of thla case, his decision was that the action was prematurely brought In his court and K was order- d striken from the docket. This la the matter In which the question at Issue is as to tha owner ship of the trade name, Blackwell Durham Tobacco Company. nomo time ago the Blackwell uurnam i- baceo Company, of thla State, cacatea Its charter and was Incorporated un der the lsws of New Jersey. This was about the time that th Ameri can Tobacco Company came In con trol of thla great business, men came the legislature of 10J which pase-d an act requiring all foreign companies to file with the secretary of Htate certain Information and to domesticate under the law of the State. For refusing or filling to com ply with this law It mad It we amy of the Attorney General to sue for IS 00. The Blackwell Durham To-bax-o Company, of New Jersey, it Is claimed, never compiled with this law and there was no recognition of the company in this State according to the lsws of the Htate. HEQINNINU OF THE TROUBLE. Then followed this action that Is ow In the courts. Two brothers of tho late Col. W. T. Blackwell. Messrs (). H. and J. w. Blackwell, ana Messrs. W. A. and W. B. Guthrie organized a company for the purpose of manufacturing smoking iodocco in this Btate. Application was made for charter under the name of the Black well Durham Tobacco Company. This waa granted. Immediately the newly incorporated concern made applica tion to the courts for a permsnent re straining order against the Blackwell Durham Tobacco Company, or new Jersey, and the American Tobacco Company, the alleged owner of the company named, from doing business in this State under tne name ox me Ulackwell Durham Tobacco Company. Then followed the application to Judge Prltchard s court for an order of removal from the State to the Fed eral Courts, followed by an applica tion to the 8tate courts for the same removal. Judge Prltchard decided that It waa not a matter for the Federal Court at this time and the action was striken from his dockets. Monday night of thla wee Judste Moore heard argument as to the ap plication for removal from the courts f.f this State. The matter was ably nrgued by Mr. Junius "Parker, of New York, and Mr. F. I Fuller, or Dur ham, for the defendants, anfl the Messrs. Outhrle for the plaintiff Judge Moore took the matter under consideration and the opinion and de- Islon of the court was delivered late this afternoon, Jirst before the ad journment of the court. As ten days Is allowed the defendants In wnicn to t.ike such action as they may deem proper, no notice waa given this af ternoon. Regarding the order that O. W. Warns be made a party to the litiga tion, the facts are as follows: After the filing of the first complaint the plaintiffs filed an amended ooirvpiami. In the original company tha Ulack well Durham Tobaooo Company, and th American Tobaooo Company, New Jersey. Messrs. C. W. Toms, W. W. Flowers and I). W. Andrews, of Durham, were made defatxlanla. Then was filed an amended complaint In whloh Mr. (J. W. Watts, a director of the American Tohaoco Company, and a cltlxen of Durham, was made a defendant. Thla could not bo served ten days before this term of court, as required by law, and th order of the court Is thait service now Issue moil tial Mm, this being returnable nl the next term of court In this county. Thn litigation will be fought, It Is thought, a long as either aide haa a standing In the courts of the land, both Hints and Federal. Involved In this matter are many fine points of law. STRIKES AND OTHKIl STRIKES. Thero Is another Mrlhe on at the Bull Tobacco Factory. At least It seems to be the third edition of the original strike that was brought about several (leys ago. After the second strike a day or so ago, the company raised the amount of wages given the runners and the machine men of rhe automatic machine department but refused to recognlt the strike. Thla refusal was emphasised by refusing to tske back soma of the leaders of the strikers and th others were given employment at th new aosie. Prior le this strike th rates paid were It cents for each on hundred pound packed, this being for tho runner. and ten rents for th machine men. Under the new order of things th runners are given II 1-1 cent per hundred pound and th machine men 10 l-a cents. Everything was getting along nicely until the machine men raised a kick. They claim that the machine mn should tie paid a acala within four cents of the runnera, this being 11 1-1 centa Th demands war not grant ed and now th machine men Bar ft strike on their own account. It la not known what will be don with thla latent feature of th strike situation, but this afternoon quit ft number of men wer walking; around and refuse to work unless ther la an Increase.
