A prominent lawyer here expressed the opinion this morning that Black burn could be ill Oh led for criminal libel, the penalty of which, If con vlcted, Is a term of two years on the roads. The question has been rais ed whether Blackburn can be arrest ed until after, his term In' Congress expires. March 4. On Hearing of Blackburn's Denial He Tolls Hollcltor Brook That Xp Ac- 'Hon Will be Taken If Blackburn ; Can Sign Affidavit of Denial. , ' Observer Bureau, ' The Hollaman Building. Raleigh, Jan. 2. . Tour correspondent , entered the Governor's office at 1 o'clock to talk with His Excellency about the status of the Spencer Blackburn mat ter, and found the Governor talking over the telephone with Solicitor A. L. Brooks, at Greensboro. . The- Gov, ernor said that ho had wired Brooke thla morning to have Blackburn ar rested, as he found the Utter was In Greensboro, and to employ Edward J. Justice to assist In the prosecution for criminal libel. Solicitor Brooks told the Governor In hit message this afternoon that he went to look for Blackburn and found the latter on the street, Blackburn coming forward and saying he had learned he was to be arrested, and said that he had not made the charges against the Governor, and thst If he were arrest ed the wrong man would be taken. Blackburn manifested his desire to do anything to set himself straight In the matter, and the Oovernor told Solicitor Brooka that If Blackburn would sign an affidavit and have the latter nubllshed In the papera In this Ktate and elsewhere, which had pub lished the attach upon the Governor given out aa made by Blackburn, then In such case the criminal prosecu tion would be withdrawn. Blackburn was vehement In his denial that he was the man who had made any auch nubllcatlon. It was certainty a very strange situation aa one State offi cial put It. "A pretty kettle of fish." I Is remarked that It wat very strange that auch a publication wae made, and that now the matter would be up to the newspapers, wno, or course, would trace the source uf their Information aa to thla most sen sational matter. Book Commission Indignant. Observer Bureau, The Hollaman Building, Raleigh, Jan. 2. State Auditor Dixon says that the State text-book commission met to day and discussed the outrage of the charge against" the Governor publish ed In Sunday's papers over the signa ture of Congressman Blackburn, who now denlea Its authorship. The com mission decided to fully support Gov ernor Glenn In any steps he might take In the matter. The commission Is very Indignant at the absolutely unfounded chargea, which are as foolish as they are false. Auditor Dixon remarked: "I would Just as soon be convicted of being a knave aa a fool."
