WILL TRY SUMNER THURSDAY. Stayer of Powers to be Trlr1 nt Ashevllle Thursday For Murder In ' the Second Degree. Special to The Observer. ashevllle. Feb. 10-Francls Sumner, charged with the killing of Charles Powers at the Arden railway station in Buncombe county several weeks ago, - will be tried this week for murder In y the second degree. Judge Cook has set peremptorily next Thursday a the date for the commencement of the trlnl that promises to be at once interesting and hard fought. Tho State and the private prosecution do not auk that young ' Bumner pay with his life for the mur der. They do Insist that he be convict ed of murder In the second degree. The . attorneys for the accused will. It l i be- lieved. enter a plea of self-defense. They will seek to show that Mr. Powers was advancing on tho prisoner when the fa tal shot was fired. -There are a large number of witnesses summoned to testify for both the de fense and the prosecution. There are eevtral able lawyers for the prosecution and likewise equally as able lawyers for the defense. When the matter was call ed up for the purpose of fixing a time for the trial Judge Thomas A. Jone. of counsel for the defense, prayed tho ' court for a continuance of the case dur ing the remainder of this term. Judge Jones stated to the court that Col. w. W, Jones, leading eounnel for the de fer.se, was fil and that he might not be able to appear at all during this term of court. Judge Jones asked that the trial be postponed until the next term Of Superior Court for the trial of crimi nal case. After nearlng argument Judge Cook stated that he could not continue the case for the term. He said that it must be tried at this time. A good-roads campaign has recently begun In Iredell and as it Is no longer neces sary to continue the special court house tax It Is proposed that this tax be transferred to the road tax and that the ceunfy buy additional road machin ery and macatamlxe all of the public roads. The present machinery, which Is r.elng orrated by the chain gang. Is doing excellent work and the roads built have given universal satisfaction and since the people have had a taste of good roads, they are determined to have macsdam rnds everywhere possible The campaign for the roads Is warming up and the grand Jury of the Superior Court last week recommended thut thu tax he Incressed.
