BY TP. A. HILDEBRIND. . Observer Bureau, 1417 O Street, N- W Washington, March 7. . " After numerous postponements the civil service commission has conclud ed to enter upon the Investigation of the charges which Senator Simmons baa preferred against certain Federal office-holders. Commissioner Green aald this afternoon that It was his Intention to go to Raleigh early next week. The question of length of his stay at the State capital would, ho aald, depend upon developments. Should the charges against any of the office-holders appear serious, after looking into the matter at close range, he will remain in Halelgh several days and will then visit other points. It Is understood that Commissioner Green will be accompanied by an in spector from the PostoflH-e Depart ment. ATTORNEY GENERAL'S OPINION. Attorney General Bonaparte's opin ion in the case of the Wltteklnd Immi grants, who came to Charleston last December, does not materially differ so far as the status of Immigrants Is concerned, from the opinion of the Department of Commerce and Labir written by Solic itor Earle. As ex plained at the Department of Justice to-day the Attorney General, answers only the direct question asked of the President by the House committee on immigration sh to whether the Wltte klnd immigrants were unlawfully ad mitted. The opinion covers twenty typewritten pages, but the gist of It an given out to-day is that the Wltte klnd passengers were not unlawfully admitted, and that the Immigration officials had no light to exclude them at the time they entered anil have now no right to deport them. FACTS BAKED 1'1'ON. The farts upon wnlch the opinion Is based are the facts recited in So licitor Earle'K opinion that Commis sioner Watson, ailing In the name of the State, advertised and solicited In Europe and paid the transportation of these Immigrant, or wimc of them, using for this purpose money rontrlb uted by the immigration society or! some cotton tnanuf-cr urers itsxnch tlon. Tho Attorney General holds that according to the law In force at time, even Ih any one, whether an agent or State of private parties, ad- i " uruaw.uuy ami promised employment, the imml- grants who came did not come under ! an "enforceable!" conrra t, and, there- fore eou d not he denied nrlmU.ir.n ' Commissioner Watson, for lntince. may have violated the law, although the Attorney Genera) doe not pa upon that question and Solicitor Earle has declared he did not, yet, granting he did violate the law, unless he made an enforceable contract with the Immigrant brought over they could not be excluded Thlg Is, In substance. Attorney General Bona parte's opinion as r the law as It then existed, taking the fact as Mr 1 Earle gave; hut the law has been amended by th recent Congress, making It now clearly unlawful for Immigrants to enter this country whoso transportation ha been paid by any corporation, society, imxo.li tlon, prospective employer of h nWio.lv else except pos.-dtdv the State Itself The Attorney general point- this out and although does not y;,v distinctly that Commissioner Watson's acti.,n and the admission ,,f immigrant would have been unlawful If the row law of 190" had he, r, n f, Inference from his . pinion Is Verv plain.
