CONTEMPT CASE Contractors Have Agreed to Quarry instead of Blast the Hock, and TOW tsnas proceedings. Special to The Observer. Ashevllle. March 80. The hearing n the case of contempt issued against andell Bros., contractors, by Judge Cook, of Superior Court, and which was set for to-day, has been continued until next Friday. Tandell Bros, were cited to appear and show cause why they should not be attached for con tempt for violating an oraer made' by Judge Cook restraining the contrac torg from throwing rocks across the French Broad river, while conducting blasting operations in double-tracK Ing the Southern. It Is understood that Yandell Bros, have agreed to simply quarry the rock Instead of throwing it away from the tracks and, If this proves successful, tt Is believed the rule for contempt will be dismissed. It is said that this method of re moving the stone will be more expen slve to the contractors, but that they are willing to do it rather than be en Joined from continuing the work. It is also contended that In operating across the river from Riverside Park the contractors' have struck the toughest bit of xock along the entire route, and that they are now carrying out their contract at this particular point at a loss of 35,000 per mile. The whole proceedings against Yan dell Bros, grew out of the throwing of rocks across the river Into River side Park with damage to property ana possible injury to life and limb. Secretary Cortelyou has broken up a custom that has existed for ten years In the Treasury. It is that of the head of the Treasury and his as sistants lunching together. The custom waa atarted by Lyman J. Gage when he came Into the Treas ury as Secretary. March 4, 1897. Mr. Gage had been a bank president and he found time too precious to waste going away from his bank for lunch-, eon. Consequently he. had luncheon served for .himself and his principal assistant In one of the rooms of the bank. While they ate the bank officials had a sort of cabinet meeting. In hicb they swopped views as to the affairs of the bank. Mr. Gage In augurated the same custom In the Treasury. Every day shortly after 1 o clock the Secretary's messengers would set a table In his room and It would be filed with good things ar riving from the lunch room In the Treasury.
