OBJECTION TO EVIDENCE. 1 Attorney Hicks, for defense, oh Jected to this evidence, basing his argument on the ground that there was no evidence to show the goods were ordered or received by ' Row land. Attorney Argo, tor the State, cited the case of Stewart vs. Railroad 138 N. C. in which it was held that entries made in the regular course of business were admissible. Judge Long" then read moat of the opinion In this case, which was; written f by Associate Justice1 Connor, the case having been tried before Judge Long and his ruling having been sustained, In the opinion many authorities are quoted on the point at 'issue ana nearly all hold that entries similar to the one in the Stewart case are admissible. Judge Long said the evidence should come very near falling within the rule No. 2 as laid down- In the Stewart case, .v-;- - Attorneys for the prosecution asked to be allowed to place Shipping Clerk Roberta, of the King Drug Company, on the stand, saying s his testimony would bear upon the point of discussion. Roberts said be knew Dr. Rowland "and the latter cam"to the drug store either the day Henry King (of the drug firm) died or the day he was buried and asked if a package had come for him. Mr. King died April 2d. This witness was not cross-examined. v-. Allison was recalled - and said there were no othe entries . on the book concerning Dr. Rowland except the one he had referred to. If cash wefe paid, he ' would know nothing about it, as It waa his business to make entries ' where articles ; were bought on -redlt :v.''i?-'V-v?'H'..;-i--i While all 'this evidence was being taken the jury was out. Judge Long listened very attentively to the testi mony and several times put ques tions to witnesses. - None of this evidence was heard by or read to the jury. The' defense objected to all of this testimony taken iwnue tne jury was out of court. Judge Long stated at the conclusion, of Allison's evidence that he would announce his ruling later. The Jury '. was v then brought ' back and the examination of witnesses was resumed. ' DR. KNOX'S TESTIMONY. Dr. A, JW. Knox, of Raleigh, said he bad practiced sinoe 1878 and knew of the poison aconitlne. ' He said it was "a powerful depressor of the heart and nerves. What would Immediately attract attention In case of its use would be the numbness and tingling sensation and the ex tremities would be in a clammy sweeat. There would not be any special pain, only numbness and tingling. 1 A great many hypothetical ques tions were asked Dr. Knox by At torney Holding, some of them being of great length and most involved In form; in fact, some of them almost equal in length the famous ones in the Thaw trial at New York. Dr. Knox's testimony was mainly upon the different kinds of heart disease and the effect upon the body at various stages of such disease. He was closely questioned regarding mitral Insufficiency. On cross-examination he said that if this was ac companied by any other disease of the heart or If the patient were suf fering from any other disease what ever, It would cause the mitral in sufficiency to advance more rapidly. A HYPOTHETICAL QUESTION, Among the hypothetical questions the defense was allowed to aak Dr. Knox was this; "If the Jury should find Strange had heart trouble In 1905, was off duty about a fortnight in February, and some time oeiore had been engineer and immediately afterwards continued his work and during March made six days'; over time, and on April 3 was told off and died on April 6th. would he say Strange could have died of heart dis ease?" Dr. Knox replied that he would say that he could have died of heart dis ease; but it was not probable if he had had only one attack. Dr. Knox said angina pectoris was more com mon In men than In women and gen erally developed between the ages of 35 end so.
