"Whether," says the petition In urging th granting of the writ, "the government is, or Is not right In its contentions, we respectfully but very earnestly urge that the court should issue the writ. Th Attorney General also takes the position that the Supreme Court is vested by law with authority to order ay case of which a Circuit Court ef Appeals has final Jurisdiction to be brought up by certiorari and to de termine it in the same manner as if It had been taken up en appeal or (writ ef error by the defendant Mr. Bonaparte takes cognizance of the fact that the Court of Appeal failed to consider many of th gov ernment's assignments of error, and It is urged that this failure meant that Judge Landls had not committed other errors and that therefor th appellate court decision was an af firmance by it of tha other portion of th Landls' decision. It is pointed out, however, that th Standard OH Company takes th opposite view. 31 add; "Several of the questions on which the Court of Appeals thus refused to pass are i. absolutely vital, and th prosecution, must certainly fall of the contention - of th defendant can be sustained as to any on of them. The Attorney General cites a num ber of similar prosecutions now pend ing as another reason why the court should pass upon the case. It 1 understood that the petition wriU be preaented to the court when it reconvenes next Monday, but It probably will not be acted upon for some time thereafter. Bryan; treasurer, Miss Annie Foy. Oysters have been selling at retail for some days for 20 cents a quart. There are dosens of persons who ped dle them on the streets and go from house to house. Bweet potatoes are selling for about 60 cents a bushel and great quantities are brought here on boats. Turkeys are Dringing aoout It cents a pound, or about II each. Butter is very high, the usual price being 40 cents a pound. There Is very little butter mad nere, nearly the whole amount consumea oeing creamery butter. The stores which are not having "reduction" sales are doing little now adays. Most of the clothing stores are selling out. Th grocery stores, however, are doing a cash business largely and the tendency seems to be for a cash basis. Four or Ave of the largest are doing a cash business only and selling close, with the result that they are getting much of the trade. THE WEATHER.
