JaaIUf ' law yer, who discussed with much adroit neaa and Plausibility the matter Of i,inn ... 1,..fca of tha supreme Court next year. It appear that the tarma of Justices Hoke and S" Eft? ft nomtnatel at the next State eonyen - tlon. I regret exceeding, that the dtninffuiahed gentleman who wa corraled JDt- an Interview eadeavored to raise a sectional lKaue In the nom ination for these hlfh offices by at temptlnr to show discrimination aaalnst the central and western part of the State In the court aa at pres ent constituted. We In the east are surprised to learn that Justice Walker Is not a representative of western North Car olina, as much SO aa Justice Hoke. It is I fact. I believe, that Judge Walker has boen an honored and em- tent cltiaen of Mecklenburg county for thirty-five yeara. which county la aa far weirt as IreJell and adj' Ins Lincoln. In fact, all three counties are contiguous to the other. Ch ef Justice Clark lives near the center, having been for many years a resi dent of Raleigh, and Judge Allen also lives Dear the capital. Judge Hrown, the remaining mem ber of the Supreme Court. 'Is frfm that large portion lylne: east rf the Wilmington & Weldon Railroad, com prlirtng at least one-fourth of the 8tate. We are also surprised to learn that wet.rn North Carolina has been fur niching all the Demorrallc majori ties. If the gentleman will examine the electlt n returns he will discover some large majorities since lUt in n wnuie oi eie' the whole of eastern Carolina. in fM, w h&ve not had a itcpubilran ConereMsman in a a ngle eastern dis- ... . trlct since 1900. snd almost without exception the members of the Gen eral Assembly elected have been Democrats. The vote In the several eastern congressional districts offer abundant evidence on this point. Judges Brown and Hoke served faithfully for sixteen years on the superior court bench an 1 were ele vated to the Supreme Court at the same time. They have only had one term and both are entitled to an other. Our parjy gave Judges Clark and Walker a renom'natlon and they were elected for another term In It 10, and It Is fair to assume that a similar honor will be accorded to Judges Hoke and Brown next year The east will with practical unanlm Itv support b th of these judges for another term, and the militant party In the west will oresumably do like wise The bar and the voters of that section will not be so unfair and un- i Just as to dony our eastern Judge a , renomlnatlon for such sentimental i reasons as those outlined In the in terview. The gentleman who discussed this I subject haa, however, unwittingly stated the criterion by which this question will be settled. He stated, "Judlc al stature ranks higher than Judlflal residence, and eminent Ju dicial fitness Is of more importance In se'ectlon than considerations aris ing from birth or residence." To this pr pos tlon I heartily agree, and by this test we will abide. Both Judges Hoke and Brown have rendeie'l ofllelent service as members of our highest court and fulfilled tho requirements of the most critical cltl- aen. JOHN H. SMALL. Washington, N.
