MADISON SUPERIOR COURT. This court, the first one to lead in the 12th Judicial District, is now in session at Marshall for a two weeks term. Judge Boykin took his seat with the ease and confidence of a veteran, and went to his work in a way to show that he meant. busi ness. But there was a trouble in the way of smooth and rapid pro ceedings that was not calculated on. The business of the inferior court, now gone out of existence, had been transferred, neck and crop, to the higher tribunal. Many witnesses and defendants seemed to have for gotten the demise of the lower court, and few cases were ready for trial. Tb.9 docket of the inferior court had a large number of misdemeanor cises, which swelled the docket to which they were transferred; and at the time of our leaving there had not been very great reduction, though neither the Judge nor coun sel had been idle. A most interesting case came up for disposal on Tuesday, and was finally disposed of on Wednesday afternoon. The grand jury had found true bills against Jerome Ruff, Charles Price, Pinkney Kirk patrick and Colurjjbus Coward, all young men of Haywood county, for the murder of Gaither Reese, of Madison, some months since. Ruff was an officer ot Haywood county, in whose hands had been placed a process for the arrest of Reese, charged, we believe, with misde mean or. The attempt at serving that process was made in Spring Creek township, Madison county. Reese attempted to escape, and as he ran, was shot down and killed. The officer Ruff, after the killing, fled and has never been arrested. The others, apparently under the impression that the act of killing was done under warrant of law, re mained in the vicinity jntil after investigation was held. They were then arrested, and . have been ;held in Buncombe county jail'until trans ferred to Madison for trial. Gaither Reese was closely con nected with one of the mostpower lul and influential families, in Mad Lon county, and the feeling roused bv his death was intense. On the other hand the young men, Price ' Kirkpatrick and Coward belonged also to large and influential fami lies in Haywood, and the interest manifested in their behalf by their friends was equally intense. For their defence the best counsel was secured, embracing men skilled in the law, such as V. S. Lusk, J. C. L. Gudger, G. 8. Ferguson and G A. Shuford.. These gentlemen, feeling the pulse of public senti ment were not slow . to reach the conclusion that they could not safely come to trial in Madison, and presented many strong affida vits setting forth the reasons ard causes th staled them to this conclu sion. We have never, on such occasion, heard as fine arguments as were made hy each gentleman of counsel for the defence, following each other successively. Garland Ferguson was calmly eloquent and impressive. Mr. Lusk, from hia familiarity with the people of the county, spoke with an authority, and as with power, that wks masterly atJ convincing. The affidavit on the part of the State could only set forth the lact against the prayer for removal (that the widowed mother-of the slain man had exhausted all her resources in employing counsel to assist in the prosecution, and could proceed no farther. Judge Boykin said, that as against the strong statement of facts set forth by the counsel for the defense, and the fact that it was a matter in which life and liberty were so deeply involved, he would make no hesitation in giving the prisoner sucradvantflge ns tho law in such cysts readily accorded. After weighing all f.igutuents, it was ordered that the prisoner be removed for trial to the Buncombe Superi r ourt, such trial to be en tered upon on the first day of the term, Monday. August 13th. The grand jury yesterday morn ing brought in a true bill for rape against one David Bell, com mitted on the person of the wife ot Mr. Thos. J. Til- son, of Ivy township. This is one of the most atrocious cases on rec cirel, ofeawvoterized by most revolt ing and brutal particulars. We presume the criminal was brought to trial yesterday. In conversation with the farmrra of the county, we hear various and conflicting accounts of the growing tobacco crop. One of the largest, most experienced, and most judi cious of the planters expresses his opinion that the condition of the plant is universally unsatisfactory Others again say, speaking lor thir own croptvtbat they are well pleased with condition and outlook. . All agree that the corn crop is a fine one. Very copious rains have fallen, in some localities a little too boun tiful. On Monday afternoon last, one, in the nature of a cloud-burst, fell on the farm of Mr. J. J.'tWhite.clerk oMhe Superior court. The farm is on Hayes' run, three miles east of Marshall. The little etream was al most instantly turned into a raging torrent, ten or twelve feet deep. Fences were swept away, tobacco and corn torn from the hillsides, and what was not ploughed up by the waters was laid flat by the furi ous wind. Some farms were com pletely desolated. Political prospects encourage the democrats to hope good things from Madison. There is resolute purpose ti contest the ground, heretofore al most unresistingly yielded to a pre sumably impregnable majority Our Madison democratic friends are going to indulge in no boast ; but they are going to work with a de termination to deserve victory if they do not achieve it. More anon Next week Marshall will have two days of political discussion. Mr. Walker, the prohibitionist candv date tor Governor, speaks on Tuesday, and Hon. D. . G Fowle and other democratic candi dates on the State ticket speak on Wednesday. A crowd as great as Marshall can hold will be theie Worth Knowing. Mr. W.
