W Bunday, while unmercifully beatinj I 'beating Mrs. E. A Spires, his boarding house keeper in this city early this morning, was shot by her ten years old son. The wound is not serious, the ball having struck his head and jassed around the skull instead of fracturing it. . Bunday was drinking and assaulted the woman with a hatchet badly wounding her about the head, face and shoulders. It was while he had her on the floor, beating her, that the lad ran in the roani and shot him. Mrs. Spires .was sent to the hospital. Her injuries are "very serious. HOTTEST DAY THIS YEAR Van Buren, Ark., Aug. 15. A tele phone message just received from Dyer, ten miles east of here, states that five men were overcome by heat today and three have died. The other two cannot recover. They were working on rail road construction work and their names could not be learned tonight. This has been the hottest day known here this year . DEPUTIES CHARGED WITH RIOTING HELD IN BAIL Wilkesbarre, Pa., Aug. 15. The twenty-five deputies and employes of the Warnke washery at Duryea, who were arrested yesterday afternoon charged with rioting and committed to jail in default of $3000 bail each, -were given a habeas corpus hearingin court today and released upon furnishing a bond of $10,000 for the entire party. Hon. J. T. Lanahan, counsel for the prisoners, furnished the bond. Immediately after their release the deputies took a train for Duryea, where it is said they will go on duty again. FRANCE'S EXPELLED NUNS WOULD COME OVFR HERE Rome, Aug. 15. Members of the re ligious orders expelled from France, especially sisters, are applying to the vatfean authorities for permission to settle in the United States. Several of them have come to Rome personally for the purpose of urging their requests. A reply has been sent to them, pointing out that there are no vacancies in the United States, and, ibesides, calling at tention to the difficulty arising from the fact that the expelled sisters do not speak the English language. Canada has been suggested as a better field, as istrs are comnarativelv scare there and because French is spoken in a large area of the Dominion. PRINCIPALS BILL IN EQUITY IS TO BE FILED TODAY IN FEDERAL COURT AGAINST THESE THREE ROADS' AND THEIR CONNECTIONS. Special to the Gazette. Raleigh, Aug. 15. District Attorney Harry Skinner left here this morning tor Washington to bring suit in the Federal court against forty railroads. He will file a bill in equity tomorrow, in behalf of the interstate commerce commission against the Southern Rail way, the Seaboard Air Line and the At lantic Coast Line. The proceeding is instituted to enforce compliance with the order of the commission to remedy the comiplaint of discrimination against Wilmington in favor of Richmond and Norfolk in the matter of freight rates from western oints. Every railroad' in the south and west making connec tion with the three systems named is defendant to the suit. It is reported today that a seven-story hotel will be built on a corner opposite the site of the Masonic temple. Per sons interested in the hotel enternrise would neither confirm nor deny the story. Advices from Greensboro today indicate surrender on the Masonic tem ple question, and it ie now regarded as certain that Raleigh's proposition will be accepted. This will insure a large and handsome building and will make the state capital permanent headquar ters of North Carolina masonry. A $250,000 FIRE " iuamiltoii, o. Howell & Son, where the fire origi nated, was made a total wreck.. The Second National bank building, adjoin ing the Powell block on the west, was damaged considerably by fire and water, but the bank itself escaped with slight damage. While the fire was dn progress, fire broke out in Walnut street in a small grocery store. Cin cinnati was called upon for help. Two engines were sent, but by the time they arrived the fire was under control and they were not taken from the train. The Walnut street fire was easily ex tinguished. Hick's stationery store in the basement of the Howell block was destroyed. The large carpet store of Creighton & Hooven, adjoining Howell, was seriously damaged. The losses are estimated at a quarter of a million, mainly in the Howell and Second Na tional bank blocks. The loss to T. V. Howell & Son is estimated at $200,000; Second National bank, $4,000; Holbrook Bros., dry goods, $12,000; Heck, stationers, $2,000. Several offices of dentists, physicians and ar chitects were located in the Howell block and were destroyed. No state ment of the amount of insurance car ried has been made. PERMANENT SCHOLARSHIPS GIVEN BY MISS HELEN GOULD Miss Helen Gould, who has for some time been giving two scholarships in the Home Industrial school in Victoria, has placed the scholarships there per manently. These wrere formerly valued at $2000 each but now she has onade a permanent endowment of $4000. Miss Gould has always taken great interest in this institution and for this reason she made a visit to Asheville several months' aero. At that time she had been thinking of making the endow ment but it was very recently decided that she would make the sift. The Home Industrial school which has been established (for a number of years has attracted a great deal of at tention both in the north and the south for the excellent training and the busi nesslike and successful way in which it has always been conducted. "The figures "29.51" painted' on the smokestack represented the maximum speed in knots attained by the destroyer on her trial. President Sed dinger of the shipbuilding company says the Channel made an average speed of 28.64 knots in her four trial runs, during the endurance trial of one hour she averaged 26.80 knots, or nearly one knot above the speed requirements. The speedy little vessel will be turned over to the government shortly. A TIDAL WAVE DESTROYS TOWNS Fifty Bodies Have Been washed Ashore, and Fatalities May far Exeeed This Number Several Towns are Destroyed. Austin, Texas, Aug.. 15. A Culiascan, Mexico, despatch says: "The lower portion of the city of At lata, on the Pacific coast just west of Culiascan has been completely de stroyed by a tidal .wave. Not lees than fifty are drowned, but the loss of life may be several times that number. Several smaller towns along the coast are washed away. The loss of life is large. The federal and state govern ments are relieving the distress. NATIONAL MUSIC TEACHERS' ASSOCIATION WILL COME The Music Teachers' National asso ciation, which has just closed Its ses sion at Put-In-Bay, decided that Ahe ville above all others was the place for them to hold the next convention. This will be held here some time in the month of July next year. This .will be the first time that a con vention of this association was ever held in a southern town. Recently an invitation was extended to the association by the SQuthern Music Teachers' association, which held its last meeting here, and by the board of trade and the aldermen. Ctecar Thompson, late last night admitted to a newspaper man, that he no longer denied the story of Mrs. Tallerday, who makes the charge that he and "Daddy" Claffy and a man supposed to be William Bartho lin, were quarreling under her window at 4 o'clock in the morning after Minnie Mitchell disappeared, and that with them was Thompson's laundry wagon, in which it is supposed the murdered girl's body was carried to the prairie at Seventy-fourth and State streets. "I turned in my laundry wagon at the stables the night Minnie Mitchell was killed about 8:30 o'clock," he said. "I stopped and had several drinks at Clancy's saloon and then I went to the house in Calumet avenue. It musthavie been about 10 o'clock when I reached there. I met Bartholin in the house.
