Editor of The Gazette-News: The article In yesterday morning's Cltlsen was very misleading inasmuch a it stated that the Grand theater In Kalelgh was closed and could not be reopened. One would infer from I reading the article that the theater I had gone in the hands of the receiver ! through my management. Nothing could be farther from the facts. The Grand Thcuter company was organ j izeg a little over a year ago, and was j capitalized at $9000, $8500 of which 'was paid in. Before finishing th : theater they ran short of funds. They j borrowed $2500 from the Citizens National bank of Raleigh on October 111, 1909, for one year, making the I note fall due October 14, 1910. The president of the Grand Theater com jpany company wrote me to Columbia, where 1 have two theaters, asking me to come to Raleigh and see him, which 1 did the last of August. He went over the situation and told me that the company was in very bad shape, and he personally owned 1000 opera chairs which were in the building, and the Graml Theater company owed him an acount of $811.71. He made me a proposition to sell them to me, which I accepted. 1 ran the theater about toyr weeks and found thnt the com pany was hopelessly in debt and that idi on Id I put the theater on a good, paying basis others would derive the i benefit instead of myself, and finding that I could not collect my account of ,$811. 74, as the Grand Theater com pany was Insolvent, I immediately in Istructed my attorneys to bring sui against the Grand Theater compam for the above amount. When I gave my attorneys these in structions they isued a summons tn I the Grand Theater company, which . was about 8 o'clock In the evening, That night several of the Grand I Theater company sent an automobile i to Ooldsboro to get an order from ' Judge Cook apolnting a receiver to ' keep me from getting my Judgment next morning for the money ivnicb they owed me. Their reason for so doing was to protect themselves from the bunk note of $L'.'i00. The receiver was appointed; I leafed the houst from the receiver and continued to run until after fair week.
