Campbell and the school committee relative to what Is known as the "Newton Academy" property on South Main street. It is proliable that shortly the school authorities will take over the property for a long term of years with the view of establishing another public school In that section. There arc some Interesting facts connected with the Newton academy property. There are six acres in the tract, splendidly situated on the Bilt more road and within the incorporate limits o: evllle. Located on the property .- .n old brick building known as the Newton academy. More than a half-century ago the school taught there was one of the best In this, then almost a pioneer section. Further back than that even the prop erly was forever and a day set apart by Its owner, William Foster, for school purposes. It was in 1S05 that Mr. Foster deeded the property to i board of trustees lo be used for edu cational purposes, the provision bein' t.iat a school must be taught a certain number of weeks or months in each year. In 1S4S the property was In corporated by the legislature which named the trustees and since that time the property has continually been in charge of a board of trustees, vacan cies being tilled by surviving trustees upon tiie death of removal of any member of the board. About tlve vears mo J. M. Campbell leased the property for L'O years with the privilege of L'O years longer. Uiter he sub-leased to the city school authorities but the buildinc being in bad condition the school was abandoned. l,aw-suits sprang up, Mr. Campbell suing tile city for rents and the authorities suing .Mr. Campbell. The matter was com promised yesterday and since the property must always be used for edu cational purposes it is likely that the trustees will turn the property over to tile city school authorities for a long term of years. No taxes are levied against the property, which Is worth probably (15,000 and the only expense to the school authorities would be repairs to the building or erection of a new biiimuit cl.oul purposes. Henry, owner of the pa utial estate known as "Zclandia," on the crest of the mountain east of the city, waa again loser In a damage suit in Superior court last evening when the Jury in the $10,000 damage suit of Miss Fannie Arthur vs. P. S. Hen ry returned a verdict finding for the plaintiff and awarding her $2500 damages. This Is the second damage suit lost by Mr. Henry during this term of court, the first being won by John P. Arthur, brother of Miss Ar thur, tho damages amounting to $1900. ISoth law suits grew out tf blasting on Mr. Henry's property causing damage, it was alleged, to the health and property of the plaintiffs. It wiib alleged during the trial that Miss Arthur as a result of tho blast lng was seriously Impaired In health. A rumor was current prior to the trial of the last case that if Mr. Henry should lose the suit he Intended leaving Asheville permanently, hav lng grown tired, It was alleged, of be lng constantly "lawed." Frank Michael, Jr., the two years old son of Mr. and Mrs. S. A. Michael of No. 8 Batrd street, died this morn ing. The funeral services will be conducted from the residence tomor row afternoon at 4 o'clock. The In terment will be at Riverside ceme tery. French Broad lodge, No. 172, I. O. O. V., of Biltmore, will hold Its an nual memorial services In the South Biltmore Methodist church tomorrow afternoon at 3 o'clock. M. at Mopkin's chapel tomorrow at 3 p. m. Both orders: "The Beauty of the West," and "The Venus" will turn out in full. J. V. Miller, W. M., presiding. The sermon will be deliv ered by llev. S. J. W. Sprgeon. C. Sawyer, who has charge of the matter of getting members for the proposed rille club, stated today that there were still a few more names to be secured to make up the required number. The names have been se cured by sending out letters and without any personal solicitation. A site has not yet been chosen. The Asheville Electric company is having the incandescent lights re placed on South Main street. The merchants on that street did not raise the money for the lights last year which they had two years ago but this year they subscribed enough money to have the lights arranged as they are on Patton avenue. Judge Frank Carter will leave to morrow for Warrenton where he will convene a two weeks' term of Superior court Monday. This will be the last term of court that Judge Carter will hold in the Second district. August 21 he will go into the Third district to preside over the courts of that dlsi- trict during the remainder of the year. Revenue Agent Sams received the information today that Deputy Col lector McCoy, accompanied by Depu ty Marshal Roland, has Just seized a large illicit distillery in Jackson county. He also has had a report that Deputy Collectors Henry and Ensley and Deputy Marshal Shope ave recently seized a distillery near lonzo In Macon county. The firemen's memorial services will be held at the First Presbyterian church tomorrow morning at 11 clock and all members of the depart- ent. active and honorary, and also II former members are requested to eet at fire headquarters at 10:30 clock and go to the church In a body. Rev. It. F. Campbell, D. D., pastor of the church, will preach the memorial sermon. At the Theato Airdome tonight there will be three new pictures dis- layed. Both the Theato on the Square and the Airdome will be run tonight and special attention has been given to the programs at both places. These places of amusement are draw ing good houses. The pictures used are clear and distinct, and do not hurt the eyes as do some of the moving pictures. The motions are deliberate nd as natural as can be made. A special meeting will be held on er the rent on Patton avenue and Haywood street Sunday at 3:30 p. m., at which time Rev. Lucius V. Comp- ton will deliver an address on the work that Is needed In this moun tain section. Mr. Compton will also give an account of the opening of he Elcada orphanage and Faith Cot tage Rescue work and what Is being one through these institutions. All are cordially Invited to attend the service. At the tax listers' room at the court house this morning It was stat ed that the people are coming In promptly to list their taxes, but that even though the time for listing has been extended through the month of une. It Is feared that some will ne glect attending to the matter until It Is too late. The listers are being kept reasonably busy and are mak ing good progress considering that the method of listing is different from what it has been heretofore, The Ownbey'a store on Montford venue was broken Into some time last night and a few pennies left In the cash register taken. It Is probable that other articles In the store were taken but on account of the large stock of goods they could not be miss ed. Entrance was made by smashing n the glass of the front door and throwing the lock from the inside, Barefoot tracks were visible this morning and tha police are certain that the robbery was accomplished by some boys.
