According to the report of Revenue Agent Sams, which has Just been com piled for the month of August there were 5 J seizures of illicit distilleries by the revenue officers during that month. As tha result of these seiz ures there have been 10 arrests and 8 prosecutions were recommended, The special taxes collected amounted to $1160. Of the seizures made, 26 were in North Carolina, 23 in Vir ginia and 12 in Tennessee. AMUSEMENTS "Polly of the Cirvus." v When Miss Ida St. Leon, In Frederic Thompson's big success, "Polly of the Circus," comes to the Auditorium for matinee and night performance on Monday, September 18th, a surprise will be In store for theatergoers. "Polly of the Circus" was one of the big New York successes and ran for one solid year at the Liberty Theater In that city, where crowded houses attested Its great popularity. The play with all its effective scenes, quaint characters and elaborate stage effects, is one of rare delight. The company Is excellent, and the scenic equipment is lavish and elaborate. A slight automobile accident oc curred late yesterday afternoon at the intersection of Haywood street and Montford avenue, when the cars driv en by Lawrence Jones and Wyatt Marsteller collided. Mr. Jones was driving up Haywood street and was almost at the point of turning Into Montford avenue, when the car com ing up Montford avenue made the turn. An effort was made by the drivers to avoid a collision but the ears Jumped and Mr. Jones' car was slightly damaged. Owing to the fact that neither was going very fast no one was hurt and only one of the ma chines was damaged. The damages on this were slight and were sustained by Mr. Jones' machine.' PLAINTIFF SUSTAINED Bbu-k Mountain R. R. Co. Awarded N0,O(M) by KuM-rior Court of Yaiwey County. In the Superior court of Yancey county last week, the case of the Black Mountain Railway company vs. the Carolina Spruce company, C. S. Aldrlch, C. A. Oberlln, L. E. Paulk and O. E. Perry was tried and a Judg ment for $80,000 was awarded the plalntifT. The case occupied the time of the court for three days and the Judgment was awarded by the jury late Saturday afternoon. Counsel for the defense Included Gardner and Gardner of Burnsville and Judge Price rnd H. H. Shelton of Bristol. Those appearing for the defense were Hudglns, Watson ft Watson of Burns ville, Judge J. H. Mnri-imon and Thomas 8. Rollins of Ashevllle and S. E. N. Moors of Johnson City. The cose was Instituted In the Yancey Superior court last March, was re moved to the United States Circuit court and was then remanded back to the original court by Judge Jeter C. Pritchard.
