She said she was In the house when he little boy came in and said two little children had been run over by an automobile. She rushed out and saw the machine stop close to her house, 31 steps from where the children were lying in the street; that Captain Sprouse had step ped off the distance. She said the man who was driving the car got out and pulled a little coaster wagon from under the car. She went to the scene and saw Dr. Briggs i looking after the children but did not remember whether or not Plemmons had assist ed him. J. C. Hughes, the next witness, said that he was driving a dray wagon down Woodiin street and was looking house number when a man in the wagon ith him said, "there are two children killed by that automo bile." He said he looked up and saw the machine Just passing on and that it was his opinion It ran about 75 or Off feet before It stopped. He rushed own to the place and saw Dr. Briggs attending the children, but did not see Plemmons helping until e drove his machine up and took he boys, wi.h Dr. Briggs, to the hos- ital. E. M. Israel and Maj. Lawrence Young then testlned as to some obser- ations they made as to how far a person could see up Vance street, when coming down Woodfin In the direction the machine was going when the accident occurred. This testimony waa to the effect that from point at least 70 feet up Woodfin, a stretch of about 90 feet of Vance street could be seen. This testimony was corroborated by Captain Sprouse, who made the exact measurements. The latter also testlned that the auto mobile stopped at a point K4 feet from where the children were struck. He took the former point as pointed out to him by Mr. and Mrs. Blackwell He estimated that the machine had skidded 10 or 15 feet. Said IMinmions Drove Slowly. H. C. Crowell, who was driving the Arbogast car Immediately behind Plemmons, went on the stand and said that when he first saw the child ren they come out from Vance street on a coaster wagon and attempted to turn the corner but the wagon skid ded and they went directly under the machine. He said Plemmons was driving slowly and that It looked like the wagon was going faster than the machine. He said Plemmons had turned his car away from them to ward the curb but that he waa very close to Vance street when they first appeared. He also offered what might be termed expert testimony, as to the effect of applying breaks to a machine on a wet pavement, as was the condition on the afternoon of the accident He aald that a machine would skid farther than It would roll If the breaks were not applied slow ly. It waa his opinion that In an emergency a man would be likely to lock his wheels, and In that case It was more difficult to stop In a short distance. Clifford Arbogast, who was also In the machine behind, corroborated Crowell's testimony as to when the children had appeared on the street Herman Owenby, who wa In the Plemmons' machine, said that the ac cident was unavoidable, as the boys simply dashed under the car. Dr. Brlinrs Testimony. Charles A. Webb and Locke Craig, attorneys for Plemmons, asked that Dr. Briggs be called to the stand and he was sent for. He aald he did not see the accident but went to the scene and assisted with the Injured boys. He said Plemmons helped him and had one of the boy when he arrived. He took It and ordered a car to be brought to take It to the hospital He knew nothing about Which car had strcuk the boya or how far It had gone.
