P. Ballew for the killing of his nephbw, youns Buck" Trivett. The case will be tak en up Thursday morning, 11 was an nounced, and Solicitor Reynolds told a Qa.ette-Ncvs reporter that he would not ask for conviction for murder In the first degree. The circumstances of the killing will be remembered by- most Asheville people, as It created quite a little ex citement at the time. Young Trivett was killed in the sick room of his grandmother at thle residence of his uncle near the depot. It appeared that Ballew and his nephew had been on bnd terms and Trivett naa neen forbidden the house. Solicitor Reynolds stated that he proposed to try some of the more im portant cases on the docket this week. Tine first week of the term was taken up with the disposition of petty cases and most of the Jail cases have been disposed of. It is likely Wiley Black, who li now on the county roads, will be tried for engaging In the "white slave traffic" a' the Asheville hotel. He was bound to Superior court some months ago by Police Judge Adams, as was Ollie Bird, a woman who stayed at the hotel Some of the search and seizure casei may also be heard before court ad- jorns. iC'orpening Goldsmith, a negro, was today arraigned on a charge of house breaking, but the trial was not con cluded at 3 o'clock. Wlokersham Sanders, another negro, will also be tried for housebreaking. This morning Will Bassett plead guilty to a chfcjrge of assault, but wa not sentenced. Clay Hoskins, who was tried Friday for an assault on Jack Williams, an other negro, was sentenced to 30 dayr on the roads. The Jury in this cast waa out several hours and finally re turned a verdict of simple assault The two men had a fight about two weeks ago and Hoskins struck Smith on the heal with a hoe. Inflict ing a wound whiich It waa feared might prove fatal. Smith has about recovered, however. Will Whitenburg, who waa tried a few days ago and found guilty of the larceny of a rl'le, waa today granted a new trial, as it was made to appear that some of his witnesses had not been summoned, and he contends thai he can pro-e an alibi.
