DEPUTY LYDA He Is Negro Charged with Cut ting Throat of Gas Walker, Another Negro. Deputy Sheriff E. M. Lyda " this morning captured John Pen land, the negro who is charged with cutting the throat of Ous Walker, another! negro, at the sttrble of the Citixens' Dray company Sunday. He found Penland at the home of one of (he employes of the dray company In West Asheville. near Carrier's bridge. The negro left the house but made no attempt to run. Deputy Sheriff Lyda brought the prisoner to the city and he was placed in jail. - It is said that Walker is in a dangerous condi tion and Penland will be held without bond until it is ascertained whether or not Walker will recover. The officers had heard that Pen land was in that neighborhood and this morning went to effect his ar rest. Just before he reached the houe a m-sro woman saw him and went into the house, and immediately Penlend left, carrying part of his breakfast, lie. too, saw the officer and Hulked away but Mr. Lyda head ed him off and cauifht him before he had gone very far. It in said that the two men had a dispute Sunday about some money and Penland cut Walker's throat 'rom ear to ear. Walker was saved from immediate death by the quick arrival of physuins. Penland told the officer that Walk er had cursed him and had drawn a knife on him before he attacked Walker. ill FOR DISCHARGE ' DENIED BY JUDGE UIE Lawson Daugherty Is Still Un der Bond for Killing of Milton Hamby. A motion waa made in Superior court this morning by the attorneys for Lawson W. Daugherty, who is held for the murder of Milton Ham by at Black Mountain 12 years ago, that the defendant be released from further appearance at the court. The motion was made on the ground that the present grand Jury had twice re turned "not a true bill" to the pre sentments againt him, and further. that following the killing, the coro ner's jury had released him, return ing a verdict that the deed was a Justifiable homicide. In connection with the motion. Solicitor Reynolds stated to the court that he , had thoroughly Investigated the case and did not believe that conviction could be secured against Daugherty, and therefore he would not ask that he be held either in cus tody or bail. Judge Lane decided. however, that it would lie best to hold the defendant and the motion was overruled. His bond was fixed at fZOOO.
