After hearing the case against Dr. l 1: nusseu 01 r leioner, who was charged with writing whiskey pre scriptions Illegally, and who was re cently fined 1600 for the offense In po. lice court, from which he annealed. Judge Lane held that there was not sufficient evidence against Dr. Bus sell for the case to go to the Jury and he woe accordingly discharged. This action was taken after O. 8. Reynolds, counsel for the defense, had made a motion to quash the . indictment, which was overruled. "' ' ; .'. Dr. Russell was arrested on a bench warrant ordered " by Police Judge Adams, as the result of the prosecution of C. C. fceawelL who was charged with selling whiskey to J. B. Wilson without a prescription. At this trial It was brought out that Wil son had a prescription given him by Dr. Russell. It was contended by the prosecution that Wilson was not a bona fide patient of Dr. Russell. The grand Jury was dismissed, after the business had been ' disposed of, and after the county Institutions had been visited. The report of the grand Jury was that the county Jail was in good con dition and the prisoner properly cared for; also Brlttain's convict camp and the offices In the' county court house. Luther'a convict camp was found to be In a satisfactory condition with the exception of sani tation. It was recommended thnt a railing be placed around the fountain pool In the rear of the court house. 1 A separate- report waa made on the children's .home and .certain, recom mendations were made. The' admin istration was found to he satisfactory. It was recommended that the tin floor of the upper porch be painted; that the floor of the front porch -e re; paired; that the kitchen cupboard be lined with tin on account of mice; that a beater be installed in the liv ing room; that a large oak over hanging, the house tie cut down!' and fhat a white oak at the northwest corner be trimmed. . . According to the In jured man the serenade party. -f which he was a member, was passing the home of Nichols, when the latter dared him to go through bis yard. He said ha made no attempt to do so but had remarked that he would go If he wanted to. He laid Nichols then stabbed him and he ran to his home a short distance away. According to Nichols, the arenadera had talked of coming in and having a big time In his hark- yard and pal "umple hod made the suggestion.. The-unexpectedly good showing of the United States! steel corporation's quarterly report led to a seen demand for steel stocks and all the- leading issues. Trading In steel was in enormous volume, with short interests the chief purchasers. Nu merons other stocks manifested pro nounced strength. The most 'Vigorous bull movement of several . months occurred in the impulse given to speculation by the government's 'attitude- .toward the American Tobacco company's re-or-g..nlsation plan. Operations for long accounts were carried on vigorously and prices were forced upward in every quarter. Reports that banking Interests were advising purchases oh the long side of the market helped to oreate a more ' chleerful sentiment. Many stocks were up between 1 and 2. points, with business broader and more active as prices advanced.
