ACQUITTAL OF BALLEW CONFIDENTLY EXPECTED Jury Returns Verdict of Not Guilty In Perjury Caas Against . H. D. Gentrr. :. In Superior court after some of the less important cases' had been dispos ed of this morning, the case of W. Pitt Ballew, f barged with the killing or his nephew, young "Buck" Trivett, several weeks ago In a family dispute. was called and he "was arraigned for murder, Solicitor Reynolds stated that he would not ask for conviction for, murder in the first degree but in the second degree or for manslaugh ter. The jury waa then empanelled and the trial proceeded. There ' are only three witnesses fer the state and two of these were examined this morn ing. These were Coroner E. R. Mor ris and-Miss Stein,. the trained nurse. who was in the Ballew home on the night of the killing, taking care of Mr. Ballew's mother, who was very sick and afterward died, j Dr. Morris testified as to the num ber of bullet woundg'and where they were, after which Miss 8tein took the stand. Miss Stein to'ld her story of the sad affair in a'oool and collected manner and her evidence was practi cally the same as that given at' the coroner's Inquest ? ' ?. . She told ofthe trouble between Mr. Ballew and hie nephew, Allan Trivett, and of how TrtvetTg-mother sided against her brother She said that after the two -men -had had one 'die-. pute, Trivett had remarked that if Ballew had warrant sworn out for him he would kill him; and that later he had said If he bad had a chance he would have knocked Ballew In the head, and his mother said "you ought to have done it long ago." t Then she spoke of the events imme diately before the tragedy, when Bal lew, Mrs. Trivett and Paul Trivett were In the room, where the nurse was with Mrs. Ballew. They were quarreling. Allan came and tried to get In and she told' htm to go away but at -once his mother, came and opened the door antj let him in. She saw the smoke of the first shot after Itallew and Allan had had some words, but did not see the pistol; she hid her face and heard other shots. It Is likely that Paul Trlvett's tes timony will be concluded this after noon and some of the defense's wit nesses also. It Is not -thought that the trial will last very long and there are confident expressions to the effect that Ballew will be rifcqnitted.'1 In the case of H. D.
