Government Gives Notice Appeal Federal Court , Adjourns to Jan. 8. of The United States Circuit court ad journed this morning until January 8, after the case of United States vs. Illawnssee Lumher company. Involv ing the ownership of 5000 acres of land in some of the western counties had tieen concluded. As stated yes terday, the Jury in the case failed to agree on the Issue presented to then) and Judge lloyd withdrew It from them and decided It himself. His de cision, which was made late yester day afternoon, was in favor of the defendant and the government gave notice of appeal to the United States Court of Appeals. The case has oc cupied about one week in the hear ing. Much documentary evidence has been Introduced and many witnesses examined. The main issue of the case concerned the location of the land in litigation. The case came up for trial first be fore Judge Newman and the plaintiff took a non-suit. The government then brought suit again and the case was heard before Judge Boyd last summer, resulting in a mistrial, the Jury failing to agree, as in this trial. Secretary Buckner of the board of trade this morning received a letter from the secretary of the Greater Charlotte club, stating that Charlotte s making an effort to get the 1912 convention of the American AssocU- un for Highway Improvement, which meets In Richmond in a few days. The letter said that Mayor Bland, Major Hemphill of the Charlotte Ob server and President Kuyster of ho club are going to attend the conven tion and it is desired that Asheviile give Charlotte help in getting the con vention by writing letters to the offi cers of the organization. As Asheviile hopes to get the con vention herself, it would hardly be expected that much aid will be given to Charlotte, unless It Is realized that Asheviile stands no chance. In a well played game of football yesterday afternoon In the grounds of the local school the Asheviile school defeated the Mooney school of Harrl mnn by the score of 9 to 6. Mooney generally has a strong team and nenrly always Is in the championship race of the preparatory schools and the victory uf the Asheviile school was hardly ex pected even by Its morst ardent well wishers. The case of Buckner vs. the South and Western Railroad and the Caro lina company, in which the plaintiff whs asking for damages In the sum of (30,000, was non-suited in Superior court this morning. Notice of appeal from the Judgment was given by the plaintiff. There was no other business of importance before the court and a recess was taken at 1 o'clock until 10 o'clock Monday morning.
