Attorneys made an ap peal and only recently the circuit court of appeals, sitting at Richmond, order ed a new trial. The case was to be re tried here In April. Sidney Allen, a brother 'of Floyd Allen, was the first tried with Preston Dlnkens on a charge of counterfeiting. Dlnkens was convicted and Allen ac quitted, the former getting a fljfe years sentence. iJtter District Attorney A. E. Holton indicted Allen, for perjury In connection with his testimony In the counterfeiting case, and he wns tried a year ago. At the time the four broth ers were present and during the two days of the- trial they occupied iront seats In the court room. One, Floyd I Allen, was frequently found loitering in the marshal s office, and he was ap parently bent upon gaining the friend shin of the office attaches. During the trial Information was given tne united States marshal -that . before leaving Flovd county. Virginia, to eoma here for the trial of the brother, the Aliens declared that Sidney- should never, be carried .to Jail alive. Upon this infor mation the mnrshul took special pre cautions to prevent a demonstration and during the trial the brothers were kept under fclose survelllonce. When the Jury verdict of guilty was brought in and Judge Boyd passed sentence an extra force of officer was stationed In the court room and every precau tion was taken to see that the Aliens did not attempt a demonstration.! Wiley, chief of thq bureau of chemistry of the de partment bf agriculture, sent his resignation to Secretary Wilsou todav. Dr. Wiley announced that he would devote the rest of hts life to urging the creation of a national health de partment, entirely separate from any other branch of the government ser vice. His resignation became effective today. Considers Many Offers. . Pr. Wiley said he had a numhermf offers under consideration; one is a large salary by a lecture bureau, and others are of an editorial and com-, mercial nature. He declared posi tively that he would not enter husl- ' ness. Already he has agreed to de liver a series of lectures in Kansas and Colorado, and at various points in the easi. The trio shot Deputy Warden Wanner In his office, just off the chapel, which looks out onto the prison yard. Doody was shot just outside the cell house, of which he was the keep er.
