The complaint states that some time prior to July 13, 1918, the defendant told the plaintiff that he wished to re turn to Greece and wanted to sell him a lease he had on the Royal Victoria hotel at 36 South Main street and the California lunch room, also on South Main. The complaint sets forth that the defendant told the plaintiff the lease was for an unexpired term of three years; that he had the consent of his Ussor, Arthur Kantslog, who was out of the United States at the time, tb sell the lease. The plaintiff then states that he believed this to be true and purchased the lease and paid 11500 in cash, gave his note for 1250 and assumed payment of two notes of $75 each, which the defendant had given his lessor, Arthur Kaintsios. After purchasing the lease, paying for it and obtaining a written assign ment for it, the plaintiff states that he found the defendant had no right or authority from hlo lessor to sell or sublet the lease, without the written consent of his lessor. Purther, it Is claimed by the plaintiff that he found if the lease was sold, that the lessor, Arthur Kantsios, could come .in and take possession of the property with out notice; that the defendant knew this to be true at the time he sold the lease to the' plaintiff. . It is further set forth that the rep resentatlons made by the defendant to the plaintiff were false and fraudulent and made for the purpose of deceiving .ind niiBlaadinc: the plaintiff and to cheat and defraud' Wm out of .thepur chase money. It is claimed in the naDers that immediately after discov wring that tne tieienaam naa ira riB""- to dispose of the lease, the plaintin demanded of him that he returned his money, which the defendant refused to do.
