Sweeping Changes Effected by
Ruling on Long and Short
Haul Clause.
Washington, May I. Deviations by
railroads south or (he Potomac and
Ohio and east of the Mississippi rivers
from the long and short haul provision
of the law, were dealt with In a decis
ion handed down yesterday by the In
terstate commerce commission.
Hundreds of applications were made
by southern railroads for permission
to exact a higher charge on some
freight traffic to Intermediate points
than to the more distant terminals. In
many Instances the commission has
granted this permission; In others it is
denied. V '
.The decision will have the effect of
materially changing the relation of
rates now existing throughout the
south. Rates from New York, Cin
cinnati, Louisville and New Orleans to
Atlanta, Athens, Gat, or Cordele, Ga
rates from Cincinnati, Louisville and
New Orleans to . Birmingham, and
rates from Cincinnati, Louisville and
New Orleans to Rome, Ga., cannot be
exceeded at intermediate points.

First Case to go to Supreme
Court Against Southern
Pacific Railroad.
Washington, May 8. The first ease
to reach the Supreme court involving
directly the constitutionality of the
federal Income tax has been docketed.
It was an appeal 'rom the refusal of
the federal district court In southern
New York to enjoin the Union Pacific
railroad at the Instance of a stock
holder, ' Frank R. Brushaber, from
paying the tax. Twenty reasons are
assigned for holding the law uncon
stltutlonal.
The suit in the ordinary course of
business, will pot be passed upon for
at least a yetfr.
It Is claimed that the tax Is uncon
stitutional when levied on Income of
the Union Pacific between May
HIS, and October 8, 113, the date of
the paspage of the law because this
Income had been converted Into real
and personal property by the time the
law was passed.
It is urged that the law makes col
lecting -agencies out of corporations
required to deduct the tax from bond
coupons In case the bondholders have

HOUSE TO EXPEDITE
RUCKER MEASURE
Washington, May . The Rucker
bill to provide "a temporary method
of conducting the nomination and
election of United States senators" by
popular vote will be expedited In the
house by a special rule which the
house rules committee has agreed to
favorably report.
Only two hours of general debate
will be allowed when the rule la, re
ported and passed, which will be
within a short time.
The bill provides that at the regu
lar term for which any senator was
elected, at which election a represen
tative to congress is regularly to be
chosen, "a. United States senator shall
be elected for the term commencing
March 4 next, and thereafter."
In any state which has provided
machinery for choosing representa
tives at large, the senatorial proced
ure will be the sam'e as for nomina
tion or election of representative at
large. In other states it will be the
same as for the nomination or elec
tion of governor.
PRINCE ALBERT OF TECK
SUCCEEDS CONNAUGHT
Prince Albert of Teck Is 40 years
old. He was married In 1904 to Het
Royal Highness, Princess Alice of Al
bany and has one son and one daughter.
London, May 8. Prince Albert of
Teck, third son of the late Duke of
Teck, is to succeed the Duke of Con
naught as governor general of Cana
da. Official announcement of this ap
pointment was made yesterday.
