Revenue Stamps may be used indiscriminately j
upon any of the matters or things enumerated in j
schedule B, except proprietary and playing card j
stamps, for which a special use lias been provided. I
Postage stamps cannot be used in payment of the !
duty chargeable on instruments. ' i
It is the duty of the maker of an instrument to j
aflix and cancel the -stamp thereon. If he neglects J
to do so, the party for whose use it is made ma !
stamp it before it Is used; but in no ease can it be
legally used without a stamp; rtiP'if used after the
30tli of June, 13G4, and used without a stamp, it
cannot afterwards be effectually stamped. Any
failure upou the part of the maker of an instrument
to appropriately stamp it, renders him liable to a
penalty of two hundred dollars.
Suits are commenced in many States by other
process than writ, viz: r-ummons, warrant, publica
tion, petition, kc, in which case these, as the origi
nal procer, severally require stamps.
Writs of sch& facias arc subject to stamp duly as
original processes.
The jurat ofay affidavit, taken before a Justice of
the peace, Nov.. .v Public, or other oilier duly au
thorized to take ailidavits, is held to be a certificate,
and subject to a stamp d ti t v cf f cents, except when
taken in suits or legal proceedings.
Certificates of loan, in which there shall appear
any printed or w ritten evidence of an amount of mo
ney to be paid on demand, or at any time designa
ted, are subject .to stamp duty as "Promissorv
Notes:" -
The assignment of a mortgage is subject to the
same stamp duty as that imposed upon the original
instrument; that is to say, for eery sum effive hun
dred dollars, or any fractional part thereof, of the
amount secured by the mortgage, at the time of its
assignment, there mutt be affixed a stamp or stamps,
denoting a duty of fifty cents.
When two or more perccus join in the execution
of an instrument, the starrps to which the instru
ment is liable under the law, may be affixed and
cancelled by one of the parties.
In conveyances of real estate, the law provides
that the stamp affixed must answer to the value of
the estate on interest conveyed.
No stamp is required on any warrant of attorney
accompanying a bond or note, when such bond or
note has al!::e' thereto the stamp' or stamps denot
ing the duty required, pad whenever any bond or
note is secured by mortgage, but one stamp duty is
required on such papers, such stamp duty being the
highest rale required for such instruments, ortither
of them. In siuh ca-c. a note or memorandum of
the value or denomination- of Hie slamp affixed
should be made upon the margin or in the acknowl
edgment of the instrument which is not stamped.
